The provisions related to Hours of Work and Overtime shall be those contained in the Collective Agreement currently in force between the parties, except where such conditions are governed by the Provisions of this Memorandum of Agreement. The averaging of maximum hours of work outlined in this Agreement applies to all the Company’s industrial establishments or premises and to all employees covered by this Collective Agreement, notwithstanding their work location. The averaging of maximum hours of work outlined in this Agreement will allow the Company to ensure optimal allocation of resources to effectively respond to unforeseen, as well as regular fluctuations in workload, thus allowing the Company to best meet its operations and business requirements as well as customers’ and employees’ needs. The parties agree that the averaging of maximum hours of work will be based on a 26 week period. The maximum hours of work of an employee shall not exceed 1248 hours over a 26 week period. In circumstances other than those described above, the relevant provisions of the Canada Labour Code continue to apply. This Agreement shall remain in full force and effect during the term of this Collective Agreement.
