NO DISCRIMINATION CLAUSE. Any Employee member of the Union acting in any official capacity whatsoever shall not be discriminated against for his or her acts as such officer of the Union nor shall there be any discrimination against any Employee because of Union membership or activities. Nor shall any Employee be discriminated against due to sex, race, color, creed, national origin, age, disability or sexual preference. No Employee fulfilling requirements of District Council #4 bylaws may be discriminated against for so doing. All Employee members will be qualified to perform all aspects of the trade.
NO DISCRIMINATION CLAUSE. 7.1 OC and its agents agree that there shall be no discrimination, interference, restriction, or coercion exercised or practiced with respect to any employee in the matter of hiring, wage rates, training, upgrading, promotion, transfer, layoff, discipline, discharge or otherwise by reason of age, race, creed, colour, nationality, political or religious affiliations, sex or marital status, disabling conditions unrelated to job performance, nor by reason of their membership in a labour union or for the exercise of rights, privileges and benefits provided by the terms of this Agreement and the employees shall at all times and in like manner act in good faith toward OC.

The Employer and the Union agree that, for the duration of this Agreement, both will comply with all federal laws and regulations prohibiting discrimination and with all requirements and regulations of the U.S. Department of Education. It is the policy of the Hartford Public Schools that no person on the basis of race, color, religion, national origin, age, sex, height, weight, marital status or disability shall be discriminated against, excluded from participation in, denied the benefits of or otherwise be subjected to discrimination in employment or in any program or activity to which it is responsible or which it receives financial assistance from the U.S. Department of Education.

Section 4.01 There shall be no discrimination or distinction in the treatment of an individual or group in matters affecting their employment status because of race, age, religion, national origin, marital status, sex, political opinions, employee organization affiliation or non- affiliation. All Employees who wish to do so are free to join the Association and any Employee desiring not to join or wishing to sever his relation with said Association can do so at any time without impairment of his employment relationship.

In accordance with the laws of the United States, and the State of New York and the established policies and practices of the Board of Education and the OCTA, there shall be no discrimination against any teacher on the basis of race, religion, creed, color, age, sex, sexual orientation, national origin, marital status, disability, membership or participation in or association with the activities of the OCTA or other professional organizations, veteran status, or past arrests or convictions except as allowed by law. Any benefit provided to or for spouses of OCTA members under the terms and conditions of this collective bargaining agreement and/or District policy shall only be extended to individuals recognized as the member’s lawful spouse under the laws of the State of New York.
