SICK LEAVE, EMERGENCY LEAVE. 13.4.1 Each employee shall accumulate one (1) day of sick leave for each calendar month worked. An employee who works eleven (11) working days in any calendar month will be given credit for the full calendar month. Sick leave benefits shall be paid on the basis of base hourly rate applicable to the employee's normal daily work shift. A doctor's certificate of disability is needed for illnesses lasting more than five (5) consecutive working days. Sick leave is available when employees are unable to work due to a health condition regardless of whether the condition relates to physical or mental health. Such leave is also available for medical appointments or treatment.

SICK LEAVE, EMERGENCY LEAVE. Employees shall accumulate sick leave on the basis of one day per month pro-rated according to the daily hours worked by the employee. Unused sick leave shall accumulate from year to year. This leave is granted in cases of illness, injury or emergency of a custodial employee. Benefits will be expended on an hour for hour basis. Sick leave benefits shall be paid on the basis of base hourly rate applicable to the employee's daily work shift. Employees who are ill or injured may be required to present to the employer a doctor's certificate. This will usually not be requested until after the third consecutive workday. Regular employees shall be allowed to use a maximum of five (5) days of sick leave per year for an emergency. An emergency is defined as an unforeseen and suddenly precipitated occurrence of a serious nature beyond the control of the employee which threatens the well-being or the property of the employee. The emergency must be of such a nature that preplanning is not possible or could not relieve the necessity for the employee’s absence. In all cases, the reason for the emergency absence shall be submitted on a time sheet along with the supervisor’s approval. As an added incentive for employees not to be off the job sick, the District will allow an additional day of vacation for every six (6) consecutive months that an employee does not use their sick leave. This provision may be reopened in the event that any state agency indicates in writing that this provision is out of compliance with state or federal laws. Sick leave may be donated by employees to other employees of the District to the extent consistent with state law and District policy. Within five (5) days after expiration of accumulated sick leave, if an employee is not medically fit to perform his/her regular assignment, he/she will terminate or apply for the appropriate leave as provided for in Article XI.

A calendar month has been worked if an employee has completed eleven (11) workdays (time worked or paid leave) in the calendar month. For the purposes of this section, a workday is defined as a complete day of assigned work, either worked time or paid leave time. (For example, a driver who works an am, midday and pm route works a day only if s/he completes his/her am, midday and pm route.) An employee who works eleven (11) working days in any calendar month will be given credit for the full calendar month. Sick leave shall be vested when earned and may be accumulated. Sick leave benefits shall be paid on the basis of base hourly rate applicable to the employee's normal daily work shift. For absences exceeding three days, the District may require verification that an employee's use of paid sick leave is for an authorized purpose. If the District requires verification, verification must be provided to the District within a reasonable time period during or after the leave. The District’s requirements for verification may not result in an unreasonable burden or expense on the employee and may not exceed privacy or verification requirements otherwise established by law. The District may also request a doctor’s certificate for illness, regardless of the length of absence from work, if the District has a reasonable suspicion that sick leave is being used inappropriately, and if the request for the certificate of disability is made at the time the employee requests sick leave. Nothing herein shall be construed to limit the District’s right to request documentation for purposes of determining FMLA eligibility, to investigate suspicious use of leave through means other than by requesting a doctor’s certification, or to require a doctor’s certificate as a condition of granting leave without pay for employees who have exhausted sick leave.

SICK LEAVE, EMERGENCY LEAVE. Certificated employees under contract for the school year will receive twelve (12) days annual leave for illness, injury, and emergency leave, as well as to care for the employee’s ill family members (refer to RCW 49.46.210 for “Family Member” definition). Unused days shall accumulate to 180 days or to the extent allowed by law. Less than full-time (partial year or fractional FTE) employees shall be allowed illness, injury, and emergency leave on a prorated basis. Sick leave will be granted for an absence resulting from an employee's mental or physical illness, injury, or health condition; to accommodate the employee's need for medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or an employee's need for preventive medical care. Xxxx leave will also be granted for the employee to provide care for a family member with a mental or physical illness, injury, or health condition; care of a family member who needs medical diagnosis, care, or treatment of a mental or physical illness, injury, or health condition; or care for a family member who needs preventive medical care. An emergency will be defined as "any unforeseen occurrence requiring the presence of the employee including emergencies of a personal or business nature." Permission for such emergency leave shall be given by the building principal or superintendent. In the event of the superintendent's absence, permission may be submitted to a review board consisting of the building principal, two NVEA members, and two Board members. The decision of the review board will be final. When emergency/sick leave is depleted, the pay is deducted at a rate of 1/the number of the employee's contracted days and full-time equivalency (FTE) status. Physician verification for illness of more than five days is required and; absences of more than 1/2 day shall be charged as one full day of leave. Absences on any day less than 1/2 shall be charged 1/2 day of leave. In all cases of sick/emergency leave, the District will be responsible for paying the substitute. SECTION 2

SICK LEAVE, EMERGENCY LEAVE. Sick leave shall accumulate at the rate of one (1) day per calendar month for a total of twelve (12) days per year, for first year regular full-time and regular part-time employees. Beginning with the second year, regular full-time and regular part-time employees shall be credited with an advanced sick leave allowance of twelve (12) days per calendar year. Sick leave may be used for absence caused by illness, family illness, injury, maternity, quarantine or other disability. Employees shall notify their supervisor prior to absence, pursuant to established procedures. Employees absent for five (5) consecutive days or 40% of their work shifts over three (3) consecutive weeks may be requested to furnish a physician's statement regarding their illness. Each employee's portion of unused sick leave allowance shall accumulate from year to year subject to the maximum accumulation(s) provided for by law. Employees may cash in unused sick leave days above an accumulation of sixty (60) days at the ratio of one (1) full day's pay for four (4) accumulated sick leave days. The employee may cash in up to twelve (12) days per year on January 1 of each school year and cash in their balance of sick leave days at the rate of one (1) full day's pay for four (4) accumulated sick leave days at eligible separation from employment. Employees may access sick leave for the illness of an immediate family member in accordance with the Washington State Family Leave Law (RCW Chapter 49.12). Additional leave provisions (Section 19.7 Annual Leave, Section 19.8 Other Leaves) may be requested by the employee. For absences due to job-related injuries which qualify for Industrial Accident and Workmen's Compensation coverage, employees who have a sick leave balance shall be compensated by the District at their regular rate of pay by using their sick leave. If the employee also receives Worker’s Compensation time loss benefits, employees may use those funds to “buy backa portion of their sick leave. The employee will receive an updated account of their accumulated sick leave on their monthly payroll stub. An employee who is unable to perform the duties because of personal illness, maternity or other disability may, upon request, be granted leave of absence without pay at the exhaustion of sick leave.
