National Code of Practice Compliance. The parties commit to ensuring compliance with Australian Government Implementation Guidelines for the National Code of Practice (the Code), as amended from time to time, throughout the life of this Agreement. For the sake of clarification, an employee’s ordinary rate of pay shall not be reduced by the application of this Agreement. If a current employee is on a rate of pay that is above the minimum pay rate of the Agreement Level that they are transferred to then they shall remain on their current rate of pay until the minimum rate of pay increases in accordance with the Australian Fair Pay Commission. If a current employee is on a rate of pay that is below the Agreement’s minimum pay rate of the Agreement Level that they are transferred to then they shall receive the applicable increase from the date of lodgement of the Agreement with the Workplace Authority. National Code of Practice Compliance. The parties agree that if at any time, including prior to this agreement coming into force under the terms of the Workplace Relations Act, any clause of this agreement is found by a competent authority not to be compliant with the Code the parties will promptly seek to vary the agreement to ensure its compliance. If a clause is found not to be compliant, the parties agree to engage promptly and in good faith in discussions with all parties to the agreement to ensure the agreement is varied to make it Code compliant and that any such variation does not adversely effect the entitlements of employees. If the parties are unable to promptly agree on the form or content of any proposed variation for these purposes, a party to the agreement may make an application to the AIRC for conciliation and if necessary arbitration of the dispute, as provided for in clause 2.1, or may apply for a variation of the agreement.
