TOXIC SUBSTANCES. Each Contractor furnishing a toxic substance as defined by Section 875 of the Labor Law, shall provide such Authorized User with not less than two copies of a material safety data sheet, which sheet shall include for each such substance the information outlined in Section 876 of the Labor Law. Before any chemical product is used or applied on or in any building, a copy of the product label and Material Safety Data Sheet must be provided to and approved by the Authorized User agency representative.

TOXIC SUBSTANCES. The employer shall observe the following procedures when employees are required to use toxic substances covered by clause 25.1.9 of the award. Where there is an absence of adequate natural ventilation the employer shall provide ventilation by artificial means and supply an approved type of respirator and/or an approved type of hood with airline attached and in addition the employer shall provide protective clothing as approved by the Health Department; proper washing facilities together with towels, soap and a plentiful supply of hot water shall be available when required. Where an employee is using materials of the types mentioned in this sub-clause and such work continues to his/her meal break he/she shall be entitled to take washing time of ten minutes immediately prior to his/her meal break. Where this work continues to the ceasing time of the day or is finalized at any time prior to the ceasing time of the day, washing time of ten minutes shall be granted. The washing time break or breaks shall be counted as time worked. An employee required to use toxic substances shall be informed by the employer of the health hazards involved and instructed in the correct and necessary safeguards which must be observed in the use of such materials. Employees using such materials will be provided with and shall use all safeguards as required by Clause 24.3 of the award and the appropriate government authority or in the absence of such requirement such safeguards as are defined by a competent authority chosen by the union and the employer.
TOXIC SUBSTANCES. In compliance with RSA 277-A known as the Workers Right to Know Act, the vendor shall provide Material Safety Data Sheets with the delivery of any and all products covered by said law.

TOXIC SUBSTANCES. Supplier acknowledges that it is the intent of Buyer to identify and disclose where appropriate, including to Buyer’s customers, all hazardous substances contained in or added to the Products. Supplier represents and warrants that none of the following hazardous substances are present in any Product: asbestos, azo colorants and its compounds, ozone- depleting substances (CFCs, HCFCs, HBFCs, carbon tetrachloride, etc.), tributyl tin oxide (TBTO), tributyl tin (TBT), triphenyl tin (TPT),polychlorinated biphenyls (PCBs), polychlorinated terphenyls (PCTs), polychlorinated napthalenes (more than 3 chlorine atoms), short chain chlorinated parraffins (SCCPs), and nuclear or radioactive materials. Supplier warrants that all its packaging, components and/or Products supplied by Supplier will not contain higher levels of any banned substances listed below, on a homogeneous or on any other level, than as described in or currently permitted under the Laws referenced in Section 10:Cadmium and compounds, Mercury and compounds Asbestos (all types), CFCs, Chlorofluorocarbons, HCFCs, Hydrogenated, chlorofluorocarbons,CHCs, Chlorinated hydrocarbons, PBDEs, Polybrominated diphenyl ethers, PBBs, Polybrominated biphenyls PCBs, Polychlorinated biphenyls PCTs, Polychlorinated terphenyls PCP, Pentachlorophenol. Buyer may change the content listed below upon prior written notice to Supplier. Except as otherwise specified, such changes shall be effective after three (3) months after the date of notification. Consumer Product packing must be free from the above mentioned substances including: Cadmium, Mercury, Lead and Chromium IV 100 PPM (MG/KG), PVC and PVC blends 1000 PPM (MG/KG).Notwithstanding any provisions in this Purchase Order to the contrary, Supplier warrants that they will not sell any Product manufactured for, or on behalf of, Jabil or its customers to any third party, or through any market channels, unless prior written consent has been provided by Jabil. Jabil may, in its sole discretion approve or deny any such request.
TOXIC SUBSTANCES. Employees using toxic substances, or materials of a like nature, will be paid an allowance per hour. Employees working in close proximity to Employees so engaged will be paid an additional amount per hour extra. For the purpose of this allowance, toxic substances will include epoxy-based materials and all materials which include or require the addition of a catalyst hardener and reactive additives or two pack catalyst systems will be deemed to be materials of a like nature. Where an Employee is using materials of the types mentioned in this allowance, and such work continues to their meal break, they will be entitled to take a washing time of 10 minutes immediately prior to their meal breaks. Where this work continues to the ceasing time of the day, or is finished at any time prior to the ceasing time of the day, Employees are entitled to take a washing time of 10 minutes. Washing time break(s) will be counted as time worked. Workshop Allowance Employees engaged in prefabrication work off site will be paid an allowance per hour for each hour worked.
