ARTICLE UNION REPRESENTATION. Representatives of the Union may make arrangements with the job supervisor or his designated representative to meet Xxxxxxxx and other employees, provided it does not interfere with the work. The Union agrees to give such assistance as is required of it by the Employer, to secure competent and qualified men for the job. The Employers agree to recognize such reasonable number of Stewards as may time to time be appointed by the Union, but shall not be obliged to recognize such Stewards until they have been informed in writing of the names of all the Stewards as they are appointed. The Xxxxxxx shall be one of the last two (2) employees covered under the terms of this Agreement to remain provided he is competent and capable of performing the remaining work. No discrimination shall be shown against any Xxxxxxx for carrying out his duties. The Union and the Association recognize the mutual value of improving by all proper and reasonable means, the productivity of the individual xxxxxxx and both will undertake, individually and jointly, to promote such increased productivity. During the lifetime of this Agreement, the Union agrees there will be no strike, slowdown or picketing or any other act which will interfere with the regular schedule of work and member Employers agree that there will be no lockout. The Employer shall have the right to discharge or otherwise discipline employees who take part in or instigate any strike, picketing or slowdown or any other act which interferes with the regular schedule of work. The Union agrees it will not involve the Association or its member Employers in any dispute which may arise between the Union and any other Employer and the employees of such other Employer. The Union further agrees it will not condone a work stoppage or observe any picket line placed on a job site for jurisdictional purposes. The Employers each agree to sub-contract asphalt or concrete paving, curb gutter work, sewer and watermain work, landscape work, utility and heavy work, only to sub-contractors whose employees are covered by the monetary terms and conditions of a Collective Agreement with the Union. (note: Changes to this provision, if any, shall be made with the Memorandum of Agreement attached as Appendix The Employers agree to give preference to sub-contractors under Collective Agreement to Local performing milling and type work provided such sub-contractors are available, capable and bid competitively on said work. ARTICLE UNION REPRESENTATION. The Union shall have the right to appoint or otherwise select a committee of five (5) employees. The Union shall further have the right to appoint or otherwise select one (1) Xxxxxxx for each twenty-five (25) employees or fraction in excess of multiples of twenty-five (25). The Union may also select up to three (3) substitute Stewards to act only in the absence of a regular Xxxxxxx. The Union recognizes that Committee and Stewards who are appointed from among the employees, have regular duties to perform as employees of the Company. Therefore, such employees will not leave their regular work for the purpose of conducting business on behalf of the Union without first obtaining permission from their recognized Supervisors. Such permission will not be unreasonably withheld. In return for the observance of the terms of this Article, the Company shall pay Stewards and the Committee for any regular scheduled work missed for servicing grievances or other direct dealings with the Company. The Company agrees to provide the Union with a locked filing cabinet in a secure location with easy access for the Union. An employee shall not be eligible to act as a Xxxxxxx until after he has completed the probationary period of employment. The Company will pay the five (5) members of the Negotiating Committee straight time pay for time spent during the employee's regular scheduled working hours, for negotiating the renewal of the Collective Agreement up to but excluding any arbitration, conciliation or mediation proceedings. The Unit Chairperson of the Union shall be informed whenever an employee has completed his probationary period. The Employer agrees that whenever a disciplinary interview is held with an employee that becomes part of his record, a shop xxxxxxx shall be present at such interview provided a xxxxxxx is readily available. In the event that the employee requests no union representation, the xxxxxxx will be provided with an opportunity to discuss this request with the employee prior to leaving the meeting. For clarity, where a xxxxxxx is not readily available, the disciplinary interview will proceed. Any disciplinary notation placed against the record of an employee shall become null and void on considering any further disciplinary action after twelve (12) months from the date of issue, providing no notation for a similar offence has occurred during the same twelve (12) month period.
ARTICLE UNION REPRESENTATION. The Union shall name a Shop Committee of not more than five (5) members, at least one (1) of which shall be from the who shall be employees of the Company covered by this Agreement. Matters pertaining to the interpretation, application, or administration of this Agreement shall be discussed and adjusted by the Company and the Shop Committee who shall meet as often as may be deemed necessary or at least once each month during working hours with a prepared agenda of matters to be discussed and adjusted. Only Shop Committee members, a Business Representative, and/or an International Officer of the Union shall be present at meetings with the Company. The Union may designate and the Company shall recognize Shop Stewards and a Shop Stewards for such work areas as shall be agreed by the parties hereto to be reasonable and proper. The Company shall be kept informed of the name of each Shop Xxxxxxx and Shop Stewards and the work area the Union has so designated him. A Shop Xxxxxxx or Shop Xxxxxxx shall be permitted the necessary time during working hours without loss of pay to perform the functions provided by Article hereof for the settlement of a complaint or grievance; he shall not leave his work station except as provided by the said Article and only after having informed his Supervisor as to the nature of his business. The Shop Chairperson shall be available to perform his regular duties for the first four hours of his shift, after which he will be assigned his lunch and be free to perform Union Business for Consolidated employees. He must not leave the Company premises without permission from the General Manager or his designate. The Company will supply adequate office space with a telephone, desk and chairs for the Shop Chairperson to perform his duties. The Company agrees to have the office space furnished and ready for use within days of the ratification of this Agreement. The Shop Committee, Shop Stewards and Shop Stewards shall perform the functions herein provided in such manner as to promote good order and shop discipline and with the least possible interference with the regular duties of their employment.

The Business Representative of the Union shall have access to all working areas during working hours, but in no case shall his visit interfere with the progress of the work. When visiting a job, he will first advise and identify himself to the job superintendent or other supervisory personnel of the Employers.

ARTICLE UNION REPRESENTATION. It is agreed that the Business Representative of the Union shall be admitted during working hours, at reasonable times, to interview employees while on duty or to inspect working conditions provided, however, that such visits shall be calculated to cause a minimum of disturbance with the Employer's business and further that the Business Representative shall report his presence to the Store Manager on the occasion of each such visit. ARTICLE SENIORITY Seniority shall be recognized by the Employer and shall be based on the length of continuous employment with the Employer in the bargaining unit. Service shall be recognized by the Employer and shall be based on the length of continuous employment with the Employer. I Employees shall not acquire seniority during the thirty (30) worked days probationary period. However, if an employee is continued in employment after such period, seniority shall commence from the commencement of such continuous employment. Xxxxxx and recall shall be based on seniority provided the senior employee has the skill and qualifications to perform a competent job. In the event of layoffs, the employees in lower classifications may not displace employees in higher classifications. Employees with more than three (3) months of service with the Employer will be given at least one (1) week's notice in writing of layoff or one (1) week's pay in lieu of notice. Promotions within the bargaining unit shall be based on seniority provided skill and qualifications to perform the job are equal.

One member shall be chairman. The purpose of this Committee i s to deal with grievances as set out i n this Collective Agreement. It i s understood that the Union Stewards have their regular work to perform on behalf of the Hospital and the w i l l not leave work without first obtaining the permission of t e Supervisor. If, i n immediate1 upon the performance of her grievance duties, a union xxxxxxx i s required to enter an area within the Hospital i n which she i s not ordinarily employed, she shall report her presence to the supervisor i n the area entering it.
