YEAR AND WORK DAY. 1701 Work Year The work year for each position shall be determined by the District. The employee who is regularly assigned to work fewer than twelve (12) months per work year shall be notified in writing, on or before the date of issuance of the final pay check of the work year, of the return to duty date, location and work hours. The employee shall be notified in a timely manner in writing of any anticipated change in the return to duty date.

YEAR AND WORK DAY. 1401 Work Year The standard work year shall be one hundred eighty-six (186) days for the duration of this contract, inclusive of state-mandated school holidays. Notwithstanding, the standard work year for the teacher's first year of employment as a District teacher shall be one hundred eighty nine (189) days per year. At least three (3) workdays per year shall be devoted to staff development activities. Any additional days worked beyond the standard work year, and the compensation therefore, shall be subject to the mutual written agreement of the teacher and the Superintendent. If the teacher serves less than the full standard work year, the teacher's salary and any benefits based on the standard work year shall be prorated accordingly. If the Superintendent determines that an emergency closure of a site is necessary because of conditions posing a threat to the health or safety of staff and/or students, teachers in the closed site(s) shall not lose their regularly scheduled salary because of the closure. On days where sites are closed under this section, teachers may take personal leave, work remotely if available at supervisor discretion, or take unpaid leave and make the day up at a later date. 1402 Work Day The standard workday for the teacher shall consist of seven and one half (7 ½) hours exclusive of a duty-free lunch period. From time to time, the work day may be extended for reasonable periods for professional activities including but not limited to staff and committee meetings, student-teacher and parent-teacher conferences, and open house functions. If the teacher is regularly assigned to work less than the standard work day, the teacher’s salary, leave, insurance, and other quantifiable benefits shall be prorated accordingly. The prorating of insurance benefits shall be based on the premium rates. For the purposes of this paragraph, premium rates under a self-funded insurance plan shall be the COBRA rates as established by the plan administrator. During days that a building based school is in session, the teacher shall normally be granted preparation time at the rate of fifty (50) minutes per standard work day in segments of not less than twenty (20) consecutive minutes. Except as may be authorized by the supervisor, the teacher shall use preparation times exclusively for preparation activities directly related to the teacher's professional duty assignment. YEAR AND WORK DAY. The normal work day for employees is six hours each day that school is in session, however, building supervisors may add hours and/or days to the employeeswork schedule as building needs arise. Greater or fewer hours each day and greater or fewer days each week may be provided for as determined by the individual building needs. In some instances, the work year may begin a few days before school or terminate a few days after the school year, again subject to specific building needs. The specific hours to be worked each day are to be determined by the building principal and any lunch break will be exclusive of the work day. All work performed in excess of 40 hours per week shall be paid at the rate of time and one-half.

The teacher may serve less than the standard work year if initial employment begins after the scheduled commencement of the work year, if the individual teacher contract is terminated during the work year, if the teacher uses non- compensated leave, or upon the prior written agreement of the teacher and the Superintendent. In such event, the teacher’s salary, leave, and other quantifiable benefits based on the standard work year shall be prorated accordingly. 1102 Work Day The standard workday shall consist of at least seven and one half (71/2) hours inclusive of any duty-free lunch period, as required by law. Teachers shall be required to be on duty thirty (30) minutes prior to the start of school as well as thirty (30) minutes after the end of the school day. At the discretion of the Administration, the workday may be extended for reasonable periods in order to conduct customary professional activities such as faculty meetings, open house, graduation or promotion, etc.; emergencies; or due to unanticipated events that might occasionally arise. Professional activities include, but are not limited to staff meetings, committee meetings, parent teacher conferences and open house functions.   • HOURS AND WORK SCHEDULES 1. The basic department, agency or other operational unit work schedules and practices, including work schedules or practices peculiar to particular classes, in effect on the effective date of this Agreement, shall not be changed without the employer informing MSEA-SEIU in advance and negotiating the impact of such changes, if requested, on the affected employees. Negotiations shall occur no longer than a thirty (30) day period prior to the implementation of the change. If the parties have not reached agreement within the thirty (30) day period, the obligation to bargain shall continue.
