Terms of Policies to Govern. The extent of coverage under the insurance policies referred to in this Article shall be governed by the terms and conditions set forth in said policies. Any questions concerning coverage shall be resolved in accordance with the terms and conditions in said policy and shall not be subject to the grievance procedure set forth in this Agreement.
Terms of Policies to Govern. The extent of coverage under the insurance referred to in Section 1 shall be exclusively controlled by the applicable plan documents, and covered members shall be provided with the same coverage provided to non‐FOP covered personnel at the City. The City agrees to assist employees, in a liaison capacity only, regarding communicating coverage questions to the insurance carrier. Any questions concerning coverage shall be resolved in accordance with the terms and conditions in said policies and shall not be subject to the grievance procedure set forth in this Agreement.

The extent of insurance coverage provided to employees or their dependents under this collective bargaining agreement shall be subject to and governed by the terms and conditions set forth in any applicable insurance policies or agreements or those which may be established from time to time by the County’s Health and Dental Plan Administrator. Any or all questions or disputes concerning insurance claim(s) shall not be subject to the grievance and arbitration procedure set forth in this Agreement.

The parties hereto expressly recognize that the insurance company issuing the Policies is not a party to this Agreement and shall not, as a condition precedent to the exercise of any of the rights granted by the terms of such Policies, insist on the performance of the terms of this Agreement. All obligations of the insurance company shall be limited and governed solely by the terms of the Policies.

The extent of coverage under the insurance referred to in Section 15.1 shall be exclusively controlled by the applicable plan documents, and bargaining unit employees shall be provided with the same coverage provided to all other non-Local 150 personnel at the City including those bargaining unit employees in the City’s Police Department. The City agrees to assist employees, in a liaison capacity only, regarding communicating coverage questions to the insurance carrier. Any questions concerning coverage shall be resolved in accordance with the terms and conditions of said policies and shall not be subject to the grievance procedure set forth in this Agreement.
Terms of Policies to Govern. The interpretation by the insurance company/third party administrator of the extent of coverage under the Village of Oak Brook's dental, and/or health, and/or life and/or vision plans shall be governed by the terms and conditions set forth in said plans. Any dispute concerning the correctness of the insurance company's/third party administrator's interpretation of coverage under said plan and/or the declination of benefits thereunder, in whole or in part, shall not be subject to the grievance procedure set forth in this Agreement. Nothing herein shall be interpreted to waive any right which any covered person may otherwise have to seek legal redress for denial of coverage and/or benefits under said plan.
