GRIEVANCE PROCEDURE Grievance Defined. A grievance is defined as an alleged violation of the terms and conditions of this Agreement. If any such grievance arises, it shall be submitted to the following grievance procedure. Time limits set forth in the following steps may only be extended by written agreement of the Union Representative and Employer. The Employer shall include the manager's name and contact information if a grievance is denied at Step 1 and/or Step 2. The grievance process is not available for terminations of probationary employees. Step I: Immediate Supervisor The employee, and the shop xxxxxxx if requested by the employee, shall first meet with the employee's immediate supervisor and attempt to resolve the problem. (Grievances that involve transfers or promotion shall be filed with the hiring manager.) The meeting shall be requested and scheduled within fourteen (14) calendar days of the employee's knowledge of the facts which constitute the grievance. A written statement of the grievance will be presented at this meeting by the employee/shop xxxxxxx if requested by the supervisor. The immediate supervisor shall within fourteen (14) calendar days of the meeting respond to the employee and provide an answer to the grievance. The supervisor will respond in writing if an employee is requested to submit a written statement in Step I. Any written statements issued at Step I shall not become a part of or be used in Step IV, Arbitration. Grievances involving a discharge shall be filed at Step II within fourteen (14) calendar days of being notified of the discharge. Step II: Next Level of Supervision If the matter is not resolved to the employee's satisfaction in Step I, the employee (and the shop xxxxxxx or Union Representative, if requested by the employee) shall present the grievance to the next level of supervision (or designated representative) within fourteen (14) calendar days of the immediate supervisor's decision. The next level of supervision (or designated representative) shall reply in writing within fourteen (14) calendar days following receipt of the grievance. Step III: Labor Relations Administrator and Union Representative If the matter is not resolved in Step II to the employee's satisfaction, the grievance shall be referred in writing to the Labor Relations Administrator (or designated representative) within fourteen (14) calendar days of receipt of the Step II response. GRIEVANCE PROCEDURE Grievance Defined. The parties agree that the prompt and just settlement of grievances is of mutual interest and concern. Any matter concerning wages, hours or other conditions of employment and including the interpretation, application, or enforcement of the terms of this Agreement shall constitute a grievance under the provisions set forth below. Stewards and grievance shall be allowed sufficient time to investigate, present, and process grievances without loss of pay during regularly scheduled hours of work. Attendance at grievance meeting and hearings during regularly scheduled hours of work shall not be deducted from the pay of grievance, employee witnesses or stewards. During work hours an employee shall request from his department head time to spend in the processing of grievances - such time shall not be unreasonably denied.
