PROSECUTION AND PROGRESS. Unless otherwise specified, the Contractor shall submit his/her progress schedule for the Owner's approval within 10 days after the effective date of the notice to proceed. The Contractor's progress schedule, when approved by the Owner, may be used to establish major construction operations and to check on the progress of the work. The Contractor shall provide sufficient materials, equipment, and labor to guarantee the completion of the project in accordance with the plans and specifications within the time set forth in the proposal. If the Contractor falls significantly behind the submitted schedule, the Contractor shall, upon the Owner's request, submit a revised schedule for completion of the work within the contract time and modify his/her operations to provide such additional materials, equipment, and labor necessary to meet the revised schedule. Should the prosecution of the work be discontinued for any reason, the Contractor shall notify the Owner at least 24 hours in advance of resuming operations. The Contractor shall not commence any actual construction prior to the date on which the notice to proceed is issued by the Owner.

PROSECUTION AND PROGRESS. 7-6-1 Sub-letting or Assignment Contract: The contractor shall not assign, transfer, convey, sell or otherwise dispose of the vI/hole or any part of his contract, his right title, or interest tlherein, or his power to execute such contract, to any person, firm partnership of Corporation without written consent of the Commissioner. If the contractor sub-lets the whole or any part of the work to be done under this contract he shall not under any circumstances be relieved of his liabilities and obligations. All transactions of the Superintending 'Engineer shall be w/ith the contractor, sub-contractors shall be recognised only in the capacity of employees or workmen and shall be subject to the same requirernents as to character and competence.
PROSECUTION AND PROGRESS. The Contractor will mobilize with sufficient forces such that all construction identified as part of this contract shall be substantially completed by September 30, 2021. Upon Notice of Award the Contractor will be required to submit a Progress Schedule. The Contractor shall be assessed liquidated damages in the amount of $300.00 per calendar day for any work not completed by the deadline. Liquidated damages shall be deducted from the 10% retainage held by the City. Normal workday for this project shall be 8:00 AM to 5:00 PM and the normal work week shall be Monday through Friday. The City will consider extended workdays or work weeks upon written request. No work will be allowed on City holidays (a complete list can be found on the City website). The Contractor shall not install lane closures or perform work or move equipment or materials on the traveled way that interferes with traffic flow between the hours of 6:00 am to 9:00 am and 4:00 pm to 7:00 pm (Monday through Friday), and 9:00 am to 1:00 pm on Sundays. The work will require bidder to provide all labor, administrative forces, equipment, materials and other incidental items to complete all required work. The City shall perform a Final Inspection upon notification from the contractor that all work is complete. A Punch List of found deficiencies will be submitted to the contractor upon completion of the Final Inspection. All repairs shall be completed by the Contractor at his expense prior to issuance of Final Acceptance. 10% retainage will be held from the total amount due the Contractor until Final Acceptance of work is issued by the City. The City will retain 10% of the fee due the Contractor. The retainage will be paid as the final invoice after the project has been completed and accepted. All punch-list work must be complete before release of any retainage.

PROSECUTION AND PROGRESS. 107.01 Subcontracting of Contract Work A schedule of DBE participation shall accompany each application for payment. That schedule shall list the participation by all Subcontractors for the individual payment period and the Project to date. The Contractor shall provide the Chief Executive Officer, Director of Human Relations and the County Commission with immediate notice when a Subcontractor who is a part of the Contractor’s affirmative action DBE commitment is terminated or substantially displaced by a Subcontractor who is not qualified. The individuals designated in the notice requirement in Subsection 106.04, titled “Notices” shall also be advised. The Contractor shall not Subcontract any portion of the Contract or of the Work provided therein, except the furnishing of necessary materials, without the written consent of the County of Xxxxx through its Engineer. Such consent shall not in any way relieve the Contractor of full responsibility for the performance of the Contract. Contractor will not assign or in any manner transfer this Contract, or any part or parts hereof, or interest herein, or subcontract for any Work, equipment or operations without the prior, written consent of the County. Any unauthorized assignment or transfer will be considered a breach of this Contract and result in the cancellation of the Contract at the County's discretion. If the Contract is not canceled, the assignment shall be deemed null and void. Consent by the County to one or more assignments of this Contract will not operate to exhaust the County's rights under this Section. The sale of fifty percent (50%) or more of the capital stock of the Contractor (if the Contractor is a corporation having less than ten (10) shareholders) will constitute an assignment of this Contract within the meaning of this Section. If the amount of the subcontract or the nature of the Work to be performed thereunder warrants, the County may require the Subcontractor to furnish, for the benefit of the Contractor, bonds in an amount proportioned to the amount of his subcontract, and for the same purpose and under the same Specifications as those of the general Contract. The Surety on the general Contract shall not be eligible to furnish such subcontract bonds. The County of Xxxxx reserves the right to remove forthwith from the job any Subcontractor or his equipment operating in violation of these requirements, and any costs or damages thereby incurred are assumed by the Contractor. Execute all agreements to sublet work in writing and include all pertinent provisions and requirements of the Contract. Upon request, furnish the Department with a copy of the subcontract.
