PROSECUTION OF WORK. FIRST PARTY will employ a sufficient staff to prosecute the work diligently and continuously and will complete the work in accordance with the schedule of work approved by the CITY. (See Exhibit "A," Scope of Services).
PROSECUTION OF WORK. The execution of this Agreement shall constitute Consultant's authority to proceed immediately with the performance of this Agreement. Performance of the services hereunder shall be completed within the time required herein, provided, however, that if the performance is delayed by earthquake, flood, high water, or other Act of God or by strike, lockout, or similar labor disturbances, the time for Consultant's performance of this Agreement shall be extended by a number of days equal to the number of days Consultant has been delayed.
PROSECUTION OF WORK. If the Contractor should neglect to prosecute the Work properly or fail to perform any provisions of this Contract, the District, may, pursuant to the General Conditions and without prejudice to any other remedy it may have, make good such deficiencies and may deduct the cost thereof from the payment then or thereafter due the Contractor.

(7-1-95) (Rev. 8-21-12) 108 SP1 G15R The Contractor will be required to prosecute the work in a continuous and uninterrupted manner from the time he begins the work until completion and final acceptance of the project. The Contractor will not be permitted to suspend his operations except for reasons beyond his control or except where the Engineer has authorized a suspension of the Contractor's operations in writing. In the event that the Contractor's operations are suspended in violation of the above provisions, the sum of $ 1,500.00 will be charged the Contractor for each and every calendar day that such suspension takes place. The said amount is hereby agreed upon as liquidated damages due to extra engineering and maintenance costs and due to increased public hazard resulting from a suspension of the work. Liquidated damages chargeable due to suspension of the work will be additional to any liquidated damages that may become chargeable due to failure to complete the work on time.
PROSECUTION OF WORK. In the event of a conflict between the body of this Agreement and Exhibit “A”, the provisions in the body of this Agreement shall control.

When work is requested of Consultant by SMART, all due diligence shall be exercised and the work accomplished without undue delay, within the performance time specified in the Task Order. PROSECUTION OF WORK. The Contractor shall provide sufficient labor, materials, equipment, and tools; and shall prosecute the Work with such means and methods and with such diligence as is required to attain and maintain a rate of progress necessary to ensure completion of the project within the Contract time limit in accordance with the plans, specifications, and other requirements of the Contract. Once the Contractor has begun work, the Contractor shall prosecute the Work continuously and to the fullest extent possible except for suspensions authorized or ordered by the Engineer according to Section 108.05. If approval is given to suspend the work temporarily, the Contractor shall notify the Engineer at least 24 hours in advance of resuming operations. The Contractor shall notify the Engineer at least 24 hours in advance of any changes in the Contractor’s planned operations or work requiring inspection.
PROSECUTION OF WORK. 14.1 Contractor shall keep on the site a copy of the drawings and specifications and shall at all times, give County access thereto.

PROSECUTION OF WORK. The Borrower shall diligently prosecute the work relating to the Project and complete the Project in accordance with the Construction Schedule, and in accordance with the highest standards of Borrower’s industry, using its best efforts at all times.
