WORK PERFORMED BY SUPERVISORS. Supervisory employees except for the food service supervisor shall not perform work in any job classification of this bargaining unit; however, in emergency situations (unforeseen circumstances which call for immediate attention), supervisory employees may be required to perform work within specific job classifications. Additionally, the testing of materials and instruction or training of employees, including demonstrating proper methods, will involve supervisory employees. The Employer will develop a uniform training program for new hires and substitutes after consultation with the Union.

WORK PERFORMED BY SUPERVISORS. The work of Supervisors will not include assignments to work normally performed by employees in the bargaining unit except for the purpose of training, demonstration, safety and the prevention of service failures. The Company will notify the Local Union to include stewards and/or alternate stewards, if available before performing hourly work. Before the Company uses supervisors to perform hourly work, that work will be offered to available employees. The Company will post a list for volunteers to cover unscheduled absences, increased volume and other instances where it would require a supervisor to perform hourly work. Copies of the list will be provided to the Local Unions involved, including updates. Employees who sign the list will be required to be available when called. Employees will be called in seniority order. Calls will be verified by a xxxxxxx or bargaining unit employee when possible. Guaranteed hours and overtime provided in Article 50, Section 1 will not apply to this unscheduled work. The Company will notify employees as soon as the need is known. UPS Training programs will be reviewed with the Union. The application of demonstration, training, safety and for the prevention of service failures shall be determined by mutual agreement between the Company and the Local Union. This provision will not be used as a subterfuge for hiring regular part time employees. Violations of this Article, if not resolved by the grievance committee, will be referred to the Supplemental Negotiating Committee.
WORK PERFORMED BY SUPERVISORS. Effective January 1, 2016 the Civil Service Commission rule regarding working out of class was modified, and as a result language was removed from this Article of the collective bargaining agreement. Disputes regarding working out of class may be raised to Civil Service through the appeals process established in Civil Service Rules and Regulations. The Employer recognizes that the integrity of the Bargaining Unit is of significant concern to the Union and will, consistent with available resources, attempt to maintain that integrity.

WORK PERFORMED BY SUPERVISORS. Supervisory employees shall be permitted to perform work within the Bargaining Unit only to the extent that such work is authorized by a secondary agreement, or letter of understanding, or is a normal part of their duties as provided by Civil Service classification specifications, provided that this Section shall not diminish the custody and security responsibilities of any employee. Except as provided in a secondary agreement or letter of understanding, supervisory employees above the first level of supervision will not perform Bargaining Unit work except in cases of emergency, or in cases of instruction or training of employees, including demonstrating the proper method of accomplishing the tasks assigned. The Department of Corrections shall only have the right to assign first line supervisors to a Bargaining Unit position when the number of Bargaining Unit employees scheduled for the shift who report for work is less than the authorized number of Bargaining Unit positions to start the shift, as determined by the custodial staff assignment sheet (CSAS), and the total number of Corrections Shift Supervisors 11, 12, and 13's present on the shift exceeds the total number of authorized supervisory assignments for the shift, as reflected in the CSAS in effect at that specific point in time, as approved by the department official designated by the director as having such authority and responsibility. However, not more than one first line supervisor may be assigned to a Bargaining Unit position on a shift if the total number of Corrections Shift Supervisors 11, 12, and 13's who are not on a layoff or leave of absence or workers' compensation exceeds the authorized supervisory complement (rounded up to the next whole number) for the shift as determined by the CSAS.
