Direction of Employees. The direction of employees, including the hiring, dismissal, promotion, demotion and transfer of employees, is vested exclusively in the Employer except as may be otherwise specifically provided in this Collective Agreement.

Direction of Employees i. The employer may direct an employee to carry out such duties as are within the limits of the employee' s skill, competence and training provided that such duties are not designed to promote deskilling.
Direction of Employees. Each Service Provider shall be solely responsible for all salary, wages, bonuses and commissions, employment, payroll and other benefits of and liabilities owed to (including severance and worker’s compensation and the withholding and payment of applicable taxes relating to such employment), and compliance with immigration and visa laws and requirements in respect of, its personnel assigned to perform the Scheduled Services. In performing their respective duties hereunder, all personnel engaged in providing Scheduled Services shall be under the direction, control and supervision of the Service Provider engaging such personnel, and such Service Provider shall have the sole right to exercise all authority with respect to the employment (including termination of employment), assignment and compensation of such personnel. The employees of each Service Provider engaged in providing Scheduled Services shall not, by virtue thereof, become employees of the Service Recipient receiving such Scheduled Services.

Any duties undertaken will be consistent with the Company’s responsibility to provide a safe and healthy working environment, as required under the Work Health and Safety Act 2012 (SA).
Direction of Employees. (a) The Employer shall assign at least one excluded employee of the Employer to be in attendance ‘on-site’ at each “Designated Facilities and Sites” for the duration of the “Exclusive Use Period”. That excluded employee may provide direction to the Employer’s employees, but employees are also expected to direction from any authorized managerial representative of so designated as responsible for the area of operations within which the employee is assigned. Employees are not expected to be assigned tasks by representatives that are outside the area of their assignment, expertise training.
