Article 3.5 below, Buyer shall have the right to enter Seller's property and facilities at any time with notice (except in emergency) to Seller to Maintain Buyer's facilities, systems, equipment and property as necessary. However, Buyer will not have the right to access, operate, modify or otherwise disturb facilities, systems or equipment owned by the Seller unless otherwise provided for in this Agreement.
Consistent with. Section 4.7, Tenant shall notify Landlord in writing of the manner and means in which it will remove any and all Hazardous Substances used in the Premises during its occupancy. Tenant shall also certify in writing upon delivery of Premises to Landlord on the date of the Lease expiration that all Hazardous Substances were removed in accordance with all governmental and regulatory laws.

Swedish Xxxxxxx’x policy on disabled employees, if a new bargaining unit position can be created to accommodate an incumbent nurse’s permanent disability, the Union agrees to waive seniority rights for that position. The position will not be posted, and the position will be offered to the disabled nurse.

Section 2.1(b), the provisions of SECTION FIVE of this Agreement shall be effective until September 30, 2003, and shall continue for additional three (3) year periods thereafter, unless the Company notifies the Executive in writing one (1) year prior to September 30, 2003 (or the third anniversary of that date, or the date of notification of termination, in the event the Agreement continues beyond that date pursuant to the provisions of this Section 7.1(c)) that it does not intend to continue those provisions of the Agreement. Notwithstanding the foregoing, (i) if a Change of Control has occurred on or before the date on which the Agreement would be terminated by the Company in accordance with this Section 7.1, the Agreement shall not terminate with respect to that Change of Control until the end of the Employment Period, and (ii) this Agreement shall terminate if, prior to a Change in Control, the Executive ceases to be employed by the Company as a corporate officer. Consistent with. 3.1 above, the criteria for every teacher evaluation shall include the use of multi-faceted evidence of teacher practice, student learning, and professional contributions to determine the level of teacher effectiveness in measuring progress of students towards established standards of expected student achievement, such as student results on pre- tests, end-of-course tests, multiple formative and District wide benchmark assessments, objective performance-based assessments; student learning objectives; student performance on English language proficiency assessments.
Consistent with its undertakings under 6.1 above, Supplier undertakes that: (a) to the best of its knowledge (reasonable enquiries having been conducted by the Supplier),at the date of entering into force of this Agreement, neither it, nor its directors, officers or employees, have directly or indirectly, paid, promised or offered to pay, authorised the payment of, or accepted any undue money or other advantage of any kind in any way connected with the Supplier’s relationship with Unilever under this Agreement or otherwise; (b) neither it, nor its directors, officers or employees, will violate any applicable anti- bribery laws or standards. Specifically, Supplier agrees that it will not, directly or indirectly, pay, promise or offer to pay, accept or authorise the payment of any undue money or other advantage to a public official or representative of a State- owned enterprise, or to any person or entity in connection with the improper performance of any public or business function or activity. In addition, no payment shall be made to anyone for any reason on behalf of or for the benefit of Unilever which is not properly and accurately recorded in the Supplier's books and records, including amount, purpose and recipient, all of which shall be maintained with supporting documentation; (c) it shall not and shall not authorize its subcontractors, agents or other third parties to request, agree to receive or accept a financial or other advantage where, in anticipation of or in consequence thereof, a relevant function or activity is or may be performed improperly; (d) it has taken and will continue to take reasonable measures to prevent its subcontractors, agents or any other third parties, subject to its control or determining influence, from engaging in any conduct that would contravene (a), (b) or (c) above. Supplier acknowledges the importance that all entities of the Supplier group comply with the Mandatory Requirements set out in the RSP together with the requirements at 6.2 (a), (b) and (c) above. Further, Supplier undertakes to notify Unilever if it learns of or has reason to believe that any breach of any such obligation has occurred. Article 37.1, whenever a Detective or Criminalist is permanently or temporarily assigned as a supervisory sergeant or as a Detective or Criminalist supervising detectives or Criminalists in the Detectives Division or Forensic Evidence Division, the Detective or Criminalist shall be paid for all time so worked at the highest rate paid for Sergeant, Detective, or Criminalists, plus three (3) percent.
