Cessation of Production. If production of items covered by this Purchase Order is to be permanently discontinued at any time within one year after final delivery under this Purchase Order, Seller shall give Buyer at least 180 days prior written notice of such discontinuance during which xxxx Xxxxxx shall accept orders from Buyer for reasonable quantities of such items, despite such cessation of production.

Lease Suspensions Final section 3212.10 addresses the difference between a suspension of operations and production and a suspension of operations. Under final section 3212.10(a), a suspension of operations and production is a temporary relief from production obligations that a lessee may request from the BLM. This section removes economic conditions as a basis for concluding that continued operations are unjustifiable. The BLM believes that a lessee should not be able to hold a lease indefinitely merely because it is uneconomic to conduct operations. This would not promote the development and recovery of geothermal resources. In circumstances where geothermal operations are expected to become economic, the new statute provides that a lessee that is subject to the new statutory provisions could cease production for as much as 10 years in aggregate and yet hold its lease through the payment of advanced royalty (see discussion of final section 3212.15(a)(1), below).

Cessation of Production. Before procuring Material for use in the Work, Contractor will ask its suppliers whether such Material is or will soon be Obsolete Material. Contractor will not use Obsolete Material without written approval of Buyer. If at any time prior to 1 year after the later of final delivery of the Material or Final Completion of the Work incorporating the Material, Contractor learns that production, manufacturing or availability of Material or components thereof has been discontinued, or is expected to be permanently discontinued, Contractor will give Buyer written notice prior to placing any orders for such Material or components and as soon after learning of such discontinuance as is practical.
