Section 2.2. 17 The right to make reasonable rules and regulations shall be considered acknowledged functions of the 18 District. In making rules and regulations relating to personnel policies, procedures and practices, and 19 matters of working conditions, the District shall give due regard and consideration to the rights of the 20 Association and the employees and to the obligations imposed by this Agreement. 24 A R T I C L E I I I

In making rules and regulations relating to personnel policies, procedures and practices, and 32 matters of working conditions, the District shall give due regard and consideration to the rights of the 33 Association and the employees and to the obligations imposed by this Agreement. 34 37 A R T I C L E I I I 38 39 RIGHTS OF EMPLOYEES 40 41 Section 3.1. 42 It is agreed that all employees subject to this Agreement shall have and shall be protected in the 43 exercise of the right, freely and without fear of penalty or reprisal, to join and assist the Association. 44 The freedom of such employees to assist the Association shall be recognized as extending to 45 participation in the management of the Association, including presentation of the views of the 46 Association to the Board of Directors of the District or any other governmental body, group, or 47 individual. The District shall take whatever action required or refrain from such action in order to 1 assure employees that no interference, restraint, coercion, or discrimination is allowed within the 2 District to encourage or discourage membership in any employee organization.

Section 2.2. 35 The right to make reasonable rules and regulations shall be considered acknowledged functions of the 36 District. In procedures and practices, and matters of working conditions, the District shall give due regard 37 and consideration to the rights of the Association and the employees and to the obligations imposed by 38 this Agreement. Employees shall comply with all District policies and procedures adopted by the Board 39 of Directors. Employees having contact with students shall maintain reasonable standards of behavior, 40 personal cleanliness and dress. 41

Section 2.2. 29 The District and the Association agree that the above enumerations of management rights is for 30 illustrative purposes only and not to be construed or interpreted so as to exclude those prerogatives not 31 mentioned which are inherent to management, including those prerogatives granted by law or common 32 law. It is the intention of the District and the Association that the rights, powers, authority and functions 33 of management shall remain exclusively vested in the District except insofar as expressly and specifically 34 surrendered or limited by the express provisions of this Agreement.
