UNION SECURITY - AGENCY SHOP. (a) Employees covered by this Agreement at the time it becomes effective and who are members of the Union at that time shall be required, as a condition of continued employment, to continue membership in the Union or pay a service fee to the Union equal to dues and initiation fees uniformly charged for membership for the duration of this Agreement.

UNION SECURITY - AGENCY SHOP. As a condition of employment, any present or future employee covered by this Agreement who is not a member of this Union and who does not make application for membership shall pay the Union each month, a service fee as a contribution toward the administration of this Agreement in an amount equal to the regular monthly union membership dues of this Union. Employees who fail to comply with this requirement shall be discharged by the Employer within thirty (30) days after receipt of written notice to the Employer from the Union. The following terms and conditions shall apply:

All employees who are members of the UNION on the date this Agreement becomes effective or who, during the term of this Agreement, become members of the UNION, shall, as a condition of employment, remain members in good standing of the UNION during the term of this Agreement, except that an employee who has joined the UNION may resign his/her membership therein during the period of fifteen (15) days prior to the expiration of this Agreement. All employees who are not members of the UNION on the date this Agreement becomes effective or who are hired during the term of this Agreement, shall, within thirty (30) days of the date of this Agreement becomes effective or their date of hire, whichever is the later, become and remain members in good standing of the UNION during the term of this Agreement or pay the equivalent of periodic UNION dues and fees.

Effective April 1, 1984, all present employees who are members of the Union on the effective date of this Agreement shall remain members of the Union provided that such employee may resign from the Union during a fifteen (15) day period prior to the expiration of this Agreement. Notice of resignation must be in writing and presented to Union representatives during this period. The payment of dues uniformly required of the membership shall be the only requisite condition of Union membership.

UNION SECURITY - AGENCY SHOP. Subject to conditions set forth within this Article, each employee who is a member of the Union on the effective date of this Agreement, or who becomes a member of the Union during the term of this Agreement, shall, pay or tender to the Union periodic dues applicable to members, for the period from such effective date or, in the case of persons becoming a member of the Union during the term of this Agreement, following execution of a dues deduction card. Membership in the Union is not compulsory. Payment of dues or fees is not compulsory. Employees in job classifications within the collective bargaining unit are free to accept or to decline membership in the Union. Any employee who is a member of the Union may, upon proper notice, voluntarily withdraw from such Membership. Proper notice means that the employee will notify the Union and the Superintent by registered mail, return receipt requested to the Business Manager, and to the Superintent by written notice. If an employee wishes to also stop paying dues and/or withdraw their membership, he/she must so state in the notice and follow the above steps. Should the current Michigan “Right to Work” law or dues deduction law be repealed, or rendered a nullity by a final court order (that is, after appellate review, if taken or sought, has been exhausted), the applicable language from the 2012-15 Collective Bargaining Agreement in Article 4 & 5 will be restored. SAVE HARMLESS The Union agrees to assume the legal defense of any suit or action brought against the Board regarding this Article of the collective agreement. The Union further agrees to indemnify the Board as a result of said suit or action subject, however, to the following conditions:

UNION SECURITY - AGENCY SHOP. As a condition of employment, all employees included within the bargaining unit described in Article 1 of this agreement shall either become a member of the Union and pay dues and fees thereto or in lieu thereof, and shall pay an amount equal to the Union’s fee and thereafter pay to the Union each month directly an amount equal to the regular monthly dues and fees in effect for other employees in the bargaining unit who are members of the Union. This obligation shall begin when the Employer receives signed dues or other deductions authorization form signed by the employee or the effective date of this agreement or the execution date of this agreement, whichever is later. Employees must notify the Union in writing of their intention not to be a member of the Union and to pay a fair share/agency shop fee in lieu of the Union's regular monthly dues and fees in effect for other employees in the bargaining unit who are members of the Union. The Union will comply with applicable laws regarding its calculation of the fair share/agency shop fee and the information provided to non-Union members relating to that calculation. Employees who fail to join the Union and/or fail to pay the monies required by this agreement, upon written request to the Employer from the Union, shall be discharged from employment. Upon request, the Union will show proof to the Employer evidence of attempts at collection from the employee before discharge or termination is required.
UNION SECURITY - AGENCY SHOP. 10.1: Membership in the Union is not compulsory. Regular employees have the right to join, not join, maintain or drop their membership in the Union as they see fit. Neither party shall exert any pressure on or discriminate against a Bargaining Unit Member as regards such matters.
UNION SECURITY - AGENCY SHOP. As a condition of continued employment, each member of the bargaining unit who has completed his/her probationary period shall establish and maintain a membership in the Union, or shall tender to the Union a service fee equivalent to the periodic Union Dues. Service fees shall not include initiation fees or special assessments. Newly hired, transferred or rehired employees shall, as a condition of employment, join the Union or pay the service fee. The member, or the Employee paying the service fee, shall be obligated to pay the appropriate assessment, dues, and/or fees the day following the cessation of probation. The dues and/or fees/assessments shall be payable in advance for each month when a payment is due. All Employees shall execute an authorization for the deduction of Union dues or service dues. Employees shall be deemed to be members of the Union in good standing, within the meaning of this Article, if they are not in arrears in payment of initiation fees, dues and/or assessments.
