Stand By Compensation. An employee placed on any type of stand-by through the authority of the Chief of Police shall receive forty dollars ($40.00) per day. Standby pay will be paid in whole day increments. Detectives who are assigned to work standby will work in one (1) week increments. The week of standby will be defined as Thursday at 6 p.m. to the following Thursday at 6 p.m. (equivalent to 7 days). However, if the detective is required to return to duty during the standby shift, call back pay will be provided for the duration of the call back assignment consistent with the call back pay provisions in this MOU. During the standby period the assigned detective is required to be: ready to respond to calls, reachable by phone or pager, able to return to work within 45 minutes of being called and is to refrain from activities which might impair their ability to safely perform assigned duties. Standby assignments are to be made on a rotational basis. The detective assigned to work standby for a given week is to provide as much advance notice as is possible when not able to work the scheduled standby shift. Requests to forego a standby shift must be approved by the Chief of Police or his designee.

Stand By Compensation. If an employee is ordered to remain on board the vessel during his or her free time for stand-by duty under Chapter 4, Section 6 of the Seafarers’ Employment Contracts Act or for some other related important reason, the employee shall receive for each hour or part thereof 1/260 of the guaranteed wage. Instead of stand-by compensation, compensation for work performed during the stand-by time is paid as overtime pay. The employer shall aim to notify the employees of stand-by duty well in advance before the end of regular working hours. If an employee is ordered to come to the vessel during his or her free time to perform a task, the employee shall be paid a remuneration that corresponds to two hours of overtime work on a weekday if the employee is not entitled to stand-by compensation under the provisions of the first paragraph above. If an employee is required to carry a pager or some other technical device through which he or she can be reached and called to work outside the working hours included in the guaranteed wage, the employee is entitled to compensation, as defined in the wage appendix, for each day he or she is required to carry the pager or device.

Stand By Compensation. When an employee is under subpoena to appear in court during his or her non- duty hours, the employee will go to the court and stand by until called by the court and will receive pay at a premium rate of one and one-half times the basic rate for stand-by time, or, with the concurrence of the subpoenaing party, remain standing by at another location where he or she may be reached by the court by telephone. If an employee stands by at another location, no pay will be received for such stand-by time. No employee will be required to stand-by without compensation without his or her consent.
