Employee Rosters. Upon the signing of this Agreement and monthly thereafter, the Employer shall supply to the Union a list of all employees covered by this Agreement. The list shall include the name, classification, employee ID number, date of hire, hourly rate of pay, and regular hours worked and gross earnings for each employee. Each month the Employer shall also send a list of new hires and their addresses and a list of all employees who have terminated during the month. The Employer will semi-annually supply a list of current addresses of all employees covered by this Agreement.

The list shall include the name, address, employee identification number, date of hire, rehire date (if applicable), shift, FTE, job classification, division cost center number, unit, hourly rate of pay and monthly gross earnings. Each month, the Employer will provide a list of new hires and addresses, and a list of all employees who have terminated during the month via an FTP site. The new hire and termination lists shall include the same data as the monthly employee roster except for monthly gross earnings. The termination list shall include the termination date.

Employee Rosters. Effective the first full month following the signing of this Agreement, and monthly thereafter, the Employer will mail to the Union a complete list of all nurses on payroll deduction together with the remittance for that month. Employee Rosters. A roster of the working hours of each employee shall be exhibited by the Employer, so as it may be conveniently and readily seen by the employee employed. Rosters shall show the working hours of employees for at least one week in advance of the date of the roster. The Employer may change the roster with seven days notice or in the case of an emergency or unforeseen circumstance 24 hours notice or, rosters may be changed at any time by mutual agreement between the employee concerned and the Employer. For the purposes of this Agreement an “unforeseen circumstance” shall mean any circumstance that the Employer could not reasonably predict or any circumstance for which the Employer has no control (e.g. where an employee has called in sick with less than 24 hours notice). This may require an employee to be deployed to another Donut King store to temporarily cover a staff shortage due to illness or other unforeseen circumstances. 14 ovERTIME WORKED Overtime will be paid at 150% of the ordinary hourly rate for all time worked by permanent employees in excess of 38 hours weekly or 152 hours in a four week period when the overtime is worked at the request of the employer. An employee may request shifts in addition to those rostered, but if any extra time is available and worked, it will be paid at the ordinary time rate. By mutual agreement between the Employer and an employee time off with pay may be allowed in lieu of payment for overtime. Time off shall be allowed provided that the time off shall be equivalent to the extra time worked and the period for taking time off being agreed at the time of arranging the extra time shall be no later than four weeks after the extra time is worked unless the Employer and employee agree, in writing for an alternative time outside four weeks after the extra time is worked. An employee may refuse to work overtime in circumstances where the working of such overtime would result in the employee working hours which are unreasonable having regard to any risk to employee health and safety, the employee’s personal or family circumstances and the needs of the workplace; the notice (if any) given by the Employer of the extra time and by the employee of his or her intention to refuse it; or any other relevant matter.

Each month the Employer shall also electronically transmit a list of all new hires, any terminated, or transferred employees during the month.” The Committee assumes no obligation, financial or otherwise, arising out of the provisions of this Article, and the Union hereby agrees that it will indemnify and hold the Committee harmless from any claims, actions, or proceedings by any employee arising from deductions made by the Committee hereunder. Once the funds are remitted to the Union, their disposition thereafter shall be the sole and exclusive obligation and responsibility of the Union.
