Transfer to Non-Bargaining Unit Position. If an employee transfers to a non- bargaining unit position, then it is the employee’s obligation to notify the Union of the transfer to effectuate discontinuance of dues deduction.
Transfer to Non-Bargaining Unit Position. An employee who is transferred to a position within the District not covered by this Agreement shall retain all accrued seniority, but shall not accumulate any further seniority during the time the employee holds the non-bargaining unit position. An employee who returns to the bargaining unit after having been transferred to a position not covered by this Agreement may be placed in any job classification with a current vacancy or within the first ninety (90) calendar days after the initial transfer may displace another employee with less seniority in a job classification to which the returned employee has the necessary qualifications, skill, ability and experience to perform. In the event that the Employer returns an employee to the bargaining unit, the employee’s frozen seniority shall recommence as of the date the employee returns to the bargaining unit. The employee’s former classification seniority shall not be restored unless the employee returns within the first ninety (90) days of the transfer.

Transfer to Non-Bargaining Unit Position. If an employee covered by this Agreement is permanently transferred or promoted to a non-bargaining unit position within the Sheriff's Department and the employee remains in said non-bargaining unit position for a consecutive period of ninety (90) calendar days or longer, the employee shall retain the employee’s classification and departmental seniority as of the date of the transfer or promotion but the employee shall no longer accumulate additional classification and departmental seniority within the bargaining unit set forth in this Agreement while the employee is in the non-bargaining unit position. Employees returning to the bargaining unit subsequent to the expiration of the above ninety (90) calendar day period; shall have their seniority reinstated upon the date of their return and shall thereafter begin to accumulate seniority again. Employees returning to the bargaining unit from any classification other than Sergeant, Lieutenant, Captain, Corrections Administrator or Undersheriff subsequent to the expiration of the ninety (90) calendar day period shall have their seniority reinstated upon the date of their return only if they return to the bargaining unit within two (2) years of the date of the transfer or promotion. The retention of seniority as provided in this section shall not permit an employee to return to the bargaining unit as a matter of right provided in Section 10.0. During the first ninety (90) calendar days of a transfer or promotion provided by this section an employee shall be entitled to return to the position held at the time of transfer or promotion, and shall have accumulated seniority during such period.
Transfer to Non-Bargaining Unit Position. Seniority shall be retained within bargaining unit for an employee who transfers to either a supervisory position, a confidential position, or a position in a classification outside the bargaining unit with that employee having the right to exercise the seniority that they had accumulated within the bargaining unit in the event that such employee voluntarily vacates either their supervisory, confidential position, or position in another classification, and returns to the bargaining unit. Transfer to Non-Bargaining Unit Position. Any employee who is promoted or transferred to a job outside the bargaining unit will retain his bargaining unit seniority as is provided in this Agreement, but not accumulate additional bargaining unit seniority after the date of said promotion or transfer. If the City, through a promotion or demotion, returns an employee to a job within the bargaining unit, such employee will be restored to the seniority list with seniority determined according to this Section.
Transfer to Non-Bargaining Unit Position. An employee who is transferred to or accepts a position within the District not covered by this Agreement shall retain all accumulated District and classification seniority, but shall not accrue further District or classification seniority for a period up to one (1) year, at which time the employee must return to the bargaining unit or lose his/her seniority. Employees transferred to or accepting such a non-unit position shall be required to serve a new job probationary period of sixty (60) working days in the new position to prove that they have the skill and ability to perform all the requirements of the position.‌ If the employee fails to meet all the requirements of the position to the satisfaction of the Employer, the employee will be transferred back to the employee’s prior classification; provided, however, that the Employer reserves the right in its sole discretion to disqualify an employee and return the employee to the employee’s prior classification at any time during the new job probationary period. An employee will also be returned to his/her former classification during this probationary period upon the employee’s request. After completion of the new job probationary period, an employee who is returned to the bargaining unit by the Employer after having been transferred to or accepting a non- bargaining unit position may be placed in any current vacancy within the classification that the employee was assigned to prior to the transfer to the non-bargaining unit position, or in a vacancy in another classification that does not obstruct the job bidding rights of other employees.
