Position Outside the Bargaining Unit. Any nurse presently in the bargaining unit who elects to transfer to a position outside the bargaining unit, but remains in the employ of the VON, may be rehired into the bargaining unit after the Employer has complied with the job posting and recall provisions. In such an event, the returning nurse shall be credited with the seniority, which she held immediately prior to transferring out of the bargaining unit for purposes of job opportunity, lay-off and other non-monetary benefits and provisions. She shall retain her last date of hire with the Employer for the calculation of salary and any monetary benefits.

Position Outside the Bargaining Unit. (a) A nurse who is transferred to a position outside of the bargaining unit for a period of not more than one (1) year shall retain, but not accumulate, her seniority held at the time of the transfer. In the event that the nurse is returned to a position in the bargaining unit, she shall be credited with seniority held at the time of transfer and resume accumulation from the date of her return to the bargaining unit.
Position Outside the Bargaining Unit. An employee who accepts a position outside the bargaining unit accumulates his seniority during a period of ninety (90) calendar days from the effective date of his move into the new position. During this period, the employee may return to his position within the bargaining unit. At the end of this period of ninety (90) calendar days, the employee loses his seniority and all rights and advantages provided for in the present agreement. An employee shall not avail himself of the provisions of this article more than once in any two (2) year period.
