A. Seniority

Seniority and Transfers. (1) A teacher who is voluntarily transferred to a different category may, at the discretion of the Employer, have total seniority transferred to the different category. A teacher who is involuntarily transferred to a different category may elect to transfer total seniority to the different category.
(2) If the different category to which the teacher transfers is not one that has the Association's mutual agreement as a result of the "meet and confer" discussions prescribed in Section H, Subdivision 1 e. above, then the teacher may elect to accrue seniority in both the category(ies) from which the teacher transferred and the different seniority category. However, the teacher must maintain his/her license in the seniority category(ies) from which he/she transferred in order to continue to accrue seniority in those categories. Further, any teacher new to the District hired into a seniority category established without the Association's mutual agreement as a result of the "meet and confer" discussion prescribed in Section H, Subdivision 1 e. above, who holds licensure qualifying him/her to teach in another category, may elect to accrue seniority in both the different category and the established category in which the teacher holds a license, providing the teacher maintains his/her license.

24.5: The Union specifically recognizes that computer operation and coordination for the public safety computer may be performed either by police officers or by private contractors.

Seniority and Transfers. When an employee is transferred to another Department or Food and Beverage Outlet in the Bargaining Unit, she shall retain house seniority; however, unless the transfer is of a temporary nature for the probationary period or less, she must start accumulating seniority in that new Department or Food and Beverage Outlet. When the transfer is for less than the probationary period and the employee is returned to the original Department or Food and Beverage Outlet within that period of time, by the Employer or by mutual consent, the seniority for that employee will continue to accumulate in the original Department or Food and Beverage Outlet during the employee’s absence.
Seniority and Transfers. A. In the event of a layoff, the following procedure shall be followed:
1. A seniority list shall be established and agreed upon between the parties within thirty (30) days of the signing of this contract. The list shall be maintained and published annually thereafter. Within twenty (20) days of submission of the list to the President of the Association, objections to the list shall be filed. Seniority shall be defined as continuous years of employment in the Bargaining Unit (except as per Article VII) including leaves of absence to the extent specified in Article X ¶ A. The seniority of part-time teachers shall accrue at the same rate as full-time teachers. When two (2) or more teachers have the same length of service, the position of the seniority list shall be determined by a lottery system.
Seniority and Transfers. In order to encourage employees to advance themselves by transferring to new job classifications, the following provisions shall apply to protect their seniority:
(a) An employee who transfers may elect to return to his/her former job classification within forty-five (45) calendar days, with full seniority earned in the classification, and frozen seniority to his/her credit in the classification that he/she is leaving.
(b) An employee who transfers will continue to accumulate seniority in his original job classification. This seniority shall be recognized only in the event of a layoff in the new job classification, as provided in Section 8.9(d). The employee’s seniority in all other job classifications, except the original, shall be based on time spent and will be frozen with each transfer. In the event the original job classification no longer exists, the classification/department into which the employee first transferred shall become the employee’s original job classification/department.
(c) An employee transferred to a supervisory position as defined in the Labor Management Relations Act of 1947, as amended, shall, for a forty-five (45) calendar day period commencing immediately after such transfer, if he/she is removed from the supervisory position by management, have the right to return to his/her former bargaining unit position in accordance with the provisions of this Article. When an employee does so return, he/she shall have seniority based on his/her previous length of service in the bargaining unit classification. If an employee occupies a supervisory position outside the bargaining unit for a period of forty-five (45) calendar days or longer, he/she shall lose all seniority rights. The Westin shall be free to discipline supervisory employees and they shall have no recourse to the grievance procedure concerning such discipline.
