Legal Bases. We rely on a number of legal bases to collect, use, share, and otherwise process the personal information we have about you for the purposes described in this Policy. This means that we may rely on the following when processing your personal information: ▪ as is necessary to perform the Student Agreement and to provide the Services; ▪ where you have consented to the processing (noting that you may revoke such consent at any time); ▪ for RCSI to comply with a legal obligation, a court order, or to exercise and defend legal claims; ▪ to protect your vital interests, or those of others; ▪ where you have made the information public; ▪ where necessary in the public interest; and ▪ where necessary for the purposes of RCSI’s, or a third party’s, legitimate interests, such as those of visitors, members or commercial partners. In certain cases, described in more detail below, we may process ‘sensitive’ or ‘special categoriesof information, such as relating to your health. Along with the above list, we may process such information: ▪ where necessary for RCSI to carry out obligations and exercise specific rights in the context of social security and social protection law; ▪ where necessary for the purposes of preventive or occupational medicine, medical diagnosis, the promotion and provision of health or social care or treatment or the management of health or social care systems and services; and ▪ where necessary for reasons of public interest in the area of public health. Legal Bases. Section 2.1 International legal bases The international source of reference is constituted by the Conventions for the avoidance of double taxation in force between the Republic of San Marino and the partner States of the treaties (hereinafter "Bilateral Conventions"). The bilateral conventions, in addition to containing specific provisions aimed at removing or primarily mitigating the phenomena of international double taxation, envisage, as an instrument for resolving disputes that may arise between States, the amicable procedure, governed by article 25 of OECD model. The amicable procedure is an institution of direct consultation between the tax administrations of the Contracting States, which dialogue through their respective "competent authorities", in the forms deemed most suitable, with the aim of reaching an agreement on the subject of the procedure. In this sense, the MAP constitutes the instrument for the resolution of international disputes, in situations in which a resident of one of the two Contracting States believes that the measures adopted by one or both financial administrations entail or will entail against him an in accordance with the provisions of the Convention. The Republic of San Marino has concluded 23 bilateral conventions, all in force, with the aim of eliminating legal and economic double taxation2through the allocation of taxing power between the contracting states. Each of them includes a provision equivalent to Article 25 of the OECD Model, concerning friendly procedures. In order to favor a more effective and transparent management of MAPs, since 2004 the OECD has launched a project aimed at improving the functioning of the mechanisms for the settlement of international tax disputes. This project led, among other things, to the drafting of the OECD Manual on the effective management of friendly procedures ("Manual on Effective Mutual Agreement Procedures", hereinafter "MEMAP")3, which provides tax administrations and taxpayers with basic information on the functioning of MAPs, identifying some best practices with which the tax administrations of the member states should comply. The Mutual Agreement Procedures were then the subject of Action 144 of the Base Erosion and Profit Shifting ("BEPS") project5 of the OECD,which pursues the objective of making international dispute resolution mechanisms more effective by identifying certain minimum standards and best practices.
