Social Care. The Social Services and Well-being (Wales) Act was passed on 1 May 2014 and comes into effect in April 2016. From April 2016, local authorities in Wales will be legally responsible for providing information, advice and assistance to support well-being, assessment and related care and support plans of those:  Children who are in the secure estate (whether in England or Wales) who will be returning to communities in Wales, and  Certain categories of English children placed in the secure estate in Wales. PSP in Wales is working with Welsh Government, local Government and other key stakeholders in Wales to co-design and support the implementation. This includes supporting the development of a prisoners’ social care pathway and the delivery structures for prisons in Wales
Social Care. The Care Act (2014) reforms social care provision in England from April 2015 and clarifies the responsibility of local authorities to provide social care for adults in prisons and approved premises is provided on the basis of equivalence to people living in the community. The Act places a duty on prisons and probation services to cooperate with local authorities. From April 2015 English local authorities will be responsible for assessing and meeting the eligible social care needs of adult prisoners in England. PSP in England will have a key role in working with Local Authorities to introduce new social care assessment and delivery within establishments. The Social Services and Wellbeing (Wales) Act 2014 introduces broadly comparable responsibilities for prisons in Wales from 2016. Public Sector Prisons in Wales will be expected to work together with NOMS in Wales, the Welsh Government and local authorities to prepare for the implementation of the Act from April 2016.

Social Care. 6.1 The transfer of personal data between the School/Academy and the LA will always be by secure methods (See Appendix C). 6.2 The School/Academy must ensure that all personal data relating to Social Care is safely stored according to the Data Protection Act. 6.3 Once the intervention involving the young person is complete the school should observe the relevant retention schedules for the data which might include returning such records to the LA.
