July 2017. The European Union (EU) and Japan last week agreed in principle to ratify a free trade agreement (FTA) that is seen as a pointed challenge to the Xxxxx administration’s “America First” nationalism and threats of trade war. Despite being hyped as a victory for free trade over protectionism, the FTA signals the accelerating division of the world into competing trade blocs and the growing danger of trade conflict and war. The FTA, the result of four years of intense secret negotiations, must now be ratified by each member state of the EU and the Japanese parliament—a complicated process without guaranteed success. Nevertheless, the trade deal covers 640 million people, 30 percent of the world’s gross domestic product and 40 percent of global trade by volume. It is the largest of its kind ever negotiated. If ratified, it would be the biggest trading bloc in the world, ahead of the US-led North American Free Trade Agreement (NAFTA). Economic analysts have focused on the FTA’s reduction of tariffs on automobiles and dairy products. Several media outlets labelled it the “cars and cheeses deal.” Under its terms, the EU will lower restrictions on Japanese automakers in European markets, while Japan will reciprocate by eliminating its traditionally high tariffs on wine and dairy imports over the next 10-15 years. The agreement has been portrayed as a boon for European agriculture, which, due to increased competition and reduced subsidies, has been losing jobs and profits, particularly in the dairy industry. Similarly in Japan, the deal has been touted as a major boost for automakers. This was a key factor in Japan agreeing to negotiations in 2013, following the ratification of a similar agreement between the EU and South Korea in 2012. Despite these supposed benefits, progress in talks was slow and mired in sharp disagreements until the election of Xxxxxx Xxxxx. His junking of the Trans-Pacific Partnership (TPP), involving the US, Japan and 10 other nations, was a significant blow to Japanese Prime Minister Xxxxxx Xxx, who hoped the bloc would help revive the stagnant Japanese economy. July 2017. Xxxxxx Xxx JC: 1 The plaintiff, Alacran Design Pte Ltd (“Alacran”), claimed against the defendant, Broadley Construction Pte Ltd (“Broadley”), a sum of $423,407.34 for equipment supplied to Broadley in the construction of a residential development project (“the Project”), of which Xxxxxxxx was a sub-contractor. The main contractor of the Project was Singbuild Pte Ltd (“Singbuild”). It is undisputed that Xxxxxxxx owed that sum to Alacran. The dispute centres on whether a letter of undertaking discharged Broadley from liability for payment of the sum on the basis that Singbuild was authorised to pay the sum to Alacran on Xxxxxxxx’x behalf.

Details of guidelines and degree of flexibility in the parameters also need to be progressed. • Requested further development of the technical studies (wind and sunlight issues) plus view studies in a Townscape analysis. • Welcomed the central space. Should ensure that outward facing facades and elevations do not present “backs“ to the wider urban context. • Felt the mid-rise buildings were too uniform. Generally, too tall, and bulky, when compared to some of the large footprint buildings surrounding the site. • Would prefer larger breaks and greater variation between the blocks in the development zones. • Ask to explore different ways the tops of the blocks could be articulated. Seek interest to the skyline silhouette. Variation in height between the west and eastern side of the space. • Not convinced at this stage about the proposed repositioning of the tower element. Would add bulk and massing to the south of the site. Lose the gateway narrative of the previous masterplan proposal (dialogue created with the tower under construction on the northern side of Westway). • Concerned about sense of openness at ground floor level regardless of the size of building. Desire to stimulate and drive the footfall through to connect to the northern site. • Residential element tucked away in the south-eastern corner. Reassurances requested regarding quality of amenity to these units given the proximity of the tower element and the West Cross Route. • Positive about the proposed servicing strategy and supported segregation of vehicular and pedestrian movements. Concern that the route to the tunnel may involve greater land take than the currently shown, how the provision is tied into the phasing and what trigger the ability to deliver it. • Would like to see further development of the public realm and landscaping especially at the arrival space. Public realm needs to react to the buildings and vice-versa, but limited information available at this stage. The applicants are encouraged to develop features in the space to draw people through and look at the possibility of a strong public offer – a cultural / leisure space that could animate the space and ensure vitality.
July 2017. For the period post 1 July 2017 the variation is signed on the full understanding that the full costs of full regularisation as defined in this Variation will be incorporated in the budget bid for 2017/18. The intention is that no party shall be disadvantaged. If a party or any member of the party’s representative group believes that they will be financially disadvantaged from 1 July 2017, because of the implementation of regularisation, they will raise it in writing with the IBT settlement parties together with the supporting evidence. The parties will meet within 2 weeks of the issue of financial disadvantage being raised and address the issue in good faith. If agreement cannot be reached on whether or not financial disadvantage will occur, or on the extent of disadvantage, or on the appropriate remedy to mitigate it within 30 days of the matter being raised, then the parties will appoint an independent person to review the matter and make recommendations on the appropriate course of action including the remedy, if any. The parties will not unreasonably refuse to agree to the recommendations of the independent person. Term This Variation will come into effect immediately following the authorised signatures from each Settlement Party and will remain in force until the Settlement Parties agree otherwise. Ratification Each provider party, along with the HCHA, will be responsible for encouraging and seeking ratification of this Variation in accordance with the process set out in the settlement agreement.
