Where appropriate the singular includes the plural and vice versa; references to statutes or regulations include all statutory or regulatory provisions consolidating, amending or replacing the statute or regulation referred to; unless otherwise indicated references to Rules are to the adopted rules in the Florida Administrative Code; the words "including," "includes" and "include" shall be deemed to be followed by the words "without limitation"; unless otherwise indicated references to sections, appendices or schedules are to this Contract; words such as "herein," "hereof" and "hereunder" shall refer to the entire document in which they are contained and not to any particular provision or section; words not otherwise defined which have well-known technical or construction industry meanings, are used in accordance with such recognized meanings; references to Persons include their respective successors and assigns and, in the case of Governmental Persons, Persons succeeding to their respective functions and capacities; and words of any gender used herein shall include each other gender where appropriate.
Where appropriate the parties may, by mutual consent, agree to expedite the arbitration process. Expedited arbitration may proceed by agreed statement of facts and the parties may agree to request that the arbitrator deliver a decision orally at the conclusion of the hearing.
Where appropriate the University will consider a job swap process to allow an exchange of positions between an eligible employee and another continuing employee who has indicated they may accept a voluntary separation. The process will be managed on a case by case basis.
Where appropriate the use of the plural word shall include its singular and the use of the singular word shall include its plural.
Where appropriate the hirer must use any security device fitted to or supplied with the product, and hirer must ensure that he keeps the product fully charged where electrical batteries are fitted.
Where appropriate the investigation may be conducted by the Employee’s immediate manager. The appointed person must not have any prior personal involvement in the matter.
Where appropriate the Employer shall notify an employee in writing of any dissatisfaction concerning her work within 5 (five) of the employee's working days of discovery of the conduct forming the basis of the complaint exclusive of holidays and weekends. The notification shall include particulars of work performed which led to such dissatisfaction.
Where appropriate the relevant employee or the employee’s representative will discuss the matter with the employee’s supervisor. Should the dispute not be resolved, it will proceed to the appropriate management level for resolution.
