Work performed on Saturdays, Sundays and the following holidays: New Year’s Day, Family Day, Good Friday, Victoria Day (or Birthday of the Reigning Sovereign), Canada Day, Civic Holiday (Local), Labour Day, Thanksgiving Day, Christmas Day, Boxing Day shall be paid at double time at the minimum wage rate as defined in Article 29.01. Wherever all other Building Trades Locals in a particular area have Remembrance Day as a recognized holiday, by Collective Agreement, then for the purpose of this Agreement, Remembrance Day shall be recognized as a holiday and employees covered by this Agreement in that particular area shall receive the double time rate for work performed on Remembrance Day. When a holiday named above falls on a Saturday or a Sunday then the following Monday or the next regular scheduled work day shall be taken as the holiday unless other building trades in affected areas are taking the Friday before thus making Monday impractical, should Canada Day fall on a Monday to Friday weekday, it shall be taken on the day on which it falls. In a holiday week when the Monday or Friday is deemed a holiday, the regular hours of work shall be thirty-two (32) hours for that week. Therefore, overtime rates shall apply after the thirty-two (32) hours.

HOLIDAYS AND OVERTIME. At the end of the employment, the employee is deemed to have taken their holidays and overtime, so that they shall not be paid. The employer and the employee consequently establish that on the last day of the employment the holiday balance is nil. or If the employee still has holidays, which have not been taken yet, then these holidays shall be paid in cash, simultaneously with the usual final settlement. The same applies to overtime. The parties establish that NUMBER holidays and NUMBER hours of overtime shall yet be paid.

All hours worked in excess of eight (8) in a day or forty (40) hours in a week shall be paid at the rate of time and one-half. Holidays and sick leave shall be considered as days worked for the purpose of overtime pay . .. ~ When overtime is required within a department, the overtime will first be offered to the department supervisor. If he/she refuses the overtime, it will be offered to qualified employees within the department in line of their seniority, and if that employee refuses the overtime, the qualified employee with the least amount of seniority must accept the overtime. After an employee has worked twenty (20) accumulated hours of overtime within a department with no relief from other employees he/she may request that the next senior employee relieve him/her of overtime assignments until all senior employees within the department have completed twenty (20) hours of overtime work. In any event, the City reserves the right to schedule any employee for overtime work in the event of emergency.
