CUSTOMER SERVICE AGREEMENT. 4.1 To give effect to the obligations, limitations and liabilities contained in this Agreement, Provider agrees that prior to granting Customer access to the Authorized Services, Provider will enter into a Customer Service Agreement with Customer that includes (i) a grant of license to the Customer and its Customer Users which corresponds with and does not exceed Provider’s rights as set out in Section 3 and (ii) a provision according to which SAP shall be entitled to claim damages or seek equitable relief as a third party beneficiary in case the Customer violates any of the license terms of the Customer Service Agreement. Nothing in this Agreement shall prevent SAP from pursuing an action for an infringement of SAP's intellectual property rights by the Customer.

CUSTOMER SERVICE AGREEMENT. The use and viewing by Residents of the Bulk TV Service is subject to Xxxx TV's Residential Multiple Dwelling Unit (MDU) Customer Agreement (the "MDU Customer Agreement") or each Resident's contractual agreement with Xxxx TV and the Residential Customer Agreement (the "RCA") as these documents exist from time to time. In the event that Residents have not sourced their own equipment (i.e. receiver) through Xxxx TV’s rental or sales process and such equipment is provided as part of this Bulk Agreement, Bulk Subscriber undertakes to provide Residents with copies of the MDU Customer Agreement and obtain signatures acknowledging receipt by such Residents upon installation of the Bulk TV Service. Failure to obtain such signatures will be considered a material breach of the Bulk Agreement and may result in termination in accordance with Section 2 above. Bulk Subscriber also acknowledges that such Agreements are available upon request from Xxxx TV and are also available at xxx.xxxx.xx/xxxxxxxxxxxxxxxxxxx.

CUSTOMER SERVICE AGREEMENT. Reseller shall, prior to the commencement of marketing the CTS, provide its form of End User contract, if any, to GTE for its review. GTE's review shall be limited to ascertaining whether the proprietary and legal interests of GTE are adequately protected in such contract and to review the use of any protected GTE Mark. Reseller shall delete price information and max xxlete proprietary information not relating to GTE's interest from such contract prior to submitting it for review. Reseller agrees that any End User contract will contain language substantially similar to the following: "[End User] shall acquire no proprietary interest in numbers assigned by [Reseller] for its use." "The liability of [Reseller] and/or any supplier of CTS to [Reseller] for actual proven damages for any cause whatsoever, including but not limited to, any failure of or disruption of CTS provided hereunder, regardless of the form of action, whether in contract or in tort or otherwise, including negligence, shall be limited to an amount equivalent to charges payable by [End User] under this contract for services during the period of any failure or disruption of CTS. In no event shall [Reseller] and/or any supplier of CTS to [Reseller] be liable for lost profits or for any special, consequential, or punitive damages."
