Safety and Insurance Act. An employee prevented from performing her/his regular work with the Employer, due to an occupational accident that is covered by the Workplace Safety and Insurance Act and which occurred while employed by the Employer, shall receive from the Employer the difference between the amount payable by the Workplace Safety and Insurance Board and her/his regular salary. The eligibility of an employee for receipt of full salary will be determined only by the employee’s eligibility for Workplace Safety and Insurance benefits and will not be prejudiced by any previous accidents which occurred while not employed by the Employer. The employee will continue to receive full pay for a period not to exceed six (6) months at which time the Employer will review the claim and determine if the employee is to continue on full salary or receive the Workplace Safety and Insurance Board benefits only.

Safety and Insurance Act. It is understood that payment of income protection is for the sole and only purpose of protecting employees against the loss of income during time of such illness. Seniority and service will accrue and the Employer shall continue to pay its share of the premium for the benefit plans during the period of the income protection noted in this provision.

A member entitled to sick leave credits may utilize not more than six (6) working days (48 hours) per calendar year in order to care for ill dependants of the member within the member's immediate Such absence shall be deducted from the member's bank of sick credits. A member shall notify the Board in writing of his intention to claim damages against a third party for injury or illness which has caused the member to be off duty for which absence the member receives sick leave salary. The Board shall authorize the restoring of the member's accumulated sick pay credits equivalent to the amount of recovery received. In the event of any dispute between the member's physician and the Board's medical doctor concerning a member's fitness to work, the parties shall agree upon an independent physician (who may be a specialist) who shall examine the member and have access to medical records. The independent physician, in consultation with the Board's doctor and the member's physician, shall decide the fitness of the member to work (with or without restrictions). In the event the parties are unable to agree upon an independent physician an arbitrator, appointed under the arbitration provisions of the collective Agreement, shall appoint one.
