SERVICE AND WARRANTY. 6.1 Distributor shall be responsible for all installation, training and service to his customers in the Territory. Distributor undertakes to provide, at its own cost, such installation, training and service as may be necessary, at the highest possible standards. Without derogating from the generality of the above, Distributor agrees that all support, maintenance and training obligations contained in any trial agreement or maintenance agreement shall be the sole responsibility of Distributor and performed at Distributor’s own cost.
SERVICE AND WARRANTY. 10.1 NovaCare acknowledges that the Products require installation, warranty and nonwarranty service, and maintenance by skilled, trained and fully qualified Nautilus technicians (other than maintenance to be performed by the end user in accordance with Nautilus' recommended maintenance instructions). SERVICE AND WARRANTY. Western Digital warrants its newly manufactured desktop products against defects in materials and workmanship for a period of three years from the date of sale. The Company's enterprise storage products have similar warranties for a period of five years from the date of sale. The Company's warranty obligation is generally limited to repair or replacement. The Company refurbishes or repairs its products at in-house service facilities located in Singapore and at a third-party return facility located in Germany. As a response to the large increase in theft of high technology products and in an effort to deter the sale of Western Digital products on the "black market," the Company does not warrant product which is stolen. MANUFACTURING To be competitive, Western Digital must manufacture significant volumes of high quality hard drives at low unit cost. One of the essential requirements for the Company to benefit from the IBM Agreement will be its ability to utilize its own high-volume manufacturing technologies for products based upon IBM technologies, which historically have not been developed for high volume production. The Company strives to maintain manufacturing flexibility, rapidly achieve high manufacturing yields and acquire high-quality components in required volumes at competitive prices. The critical elements of Western Digital's hard drive production are high volume, low cost assembly, and testing and establishment and maintenance of key vendor relationships in order to create "virtual vertical integration." By establishing partner relationships with many of its key strategic component suppliers, the Company believes it is able to access "best-of-class" manufacturing quality without the substantial capital investment associated with actual vertical integration. In addition, the Company believes that its virtual vertical integration model enables it to have the business flexibility needed to select the highest quality low cost suppliers as product designs and technologies evolve. Hard drive manufacturing is a complex process involving the assembly of precision components with narrow tolerances and extensive testing to ensure reliability. The assembly process occurs in a "clean room" environment which demands skill in process engineering and efficient utilization of the "clean room" layout in order to reduce the high operating costs of this manufacturing environment. SERVICE AND WARRANTY. Seller shall continue to honor all warranties for all Soft Lens Line products sold by it prior to the Closing Date in accordance with its historic practices and service levels.

SERVICE AND WARRANTY. The standard of care for all professional engineering, consulting and related services performed or furnished by CONSULTANT and its employees under the Contract will be the care and skill ordinarily used by members of CONSULTANT’s profession. CONSULTANT makes no warranties, express or implied, under the Contract or otherwise, in connection with CONSULTANT’s services.
SERVICE AND WARRANTY. NBO will maintain and repair the Counter Unit in a good and safe working order and condition, and in accordance with manufacturer's recommended instructions and procedures and the requirements of any applicable insurance or manufacturer's warranty and of any governmental authority having jurisdiction over the Counter Unit during the Term of this Agreement. NBO will provide, at its own expense, all service, inspection, substitutions, materials and labor necessary for the proper use, repair, operation and maintenance of the Counter Unit. In addition, NBO will provide technical support, as well as training of Owner's employees, agents and contractors in all aspects of the use of the Counter Unit, at all times during the Term of this Agreement. All obligations of NBO under this Paragraph 5 shall continue during any extension of this Agreement. NBO warrants that repair and maintenance performed by NBO under this Agreement will be performed competently and in accordance with industry practices, and the Counter Unit and service parts furnished by NBO will be free of defects in material and manufacture upon installation thereof at the Center. Owner will grant to NBO personnel full and free access to the Counter Unit to provide installation, operation, maintenance, repair and training services (subject to Owner's security regulations), including, but not limited to, telephone and electrical service and all related wiring and necessary systems related thereto.
