Existing Products. Tangible Products and intangible licensed Products which exist prior to the commencement of work under the Contract. Contractor retains the burden of proving that a particular product was existing before commencement of the Project. .

Existing Products has the meaning set forth in Section 7.6(b).

• Except as set forth below, Contractor shall retain all rights, title and interest in Existing Products.

More Definitions of Existing Products

Existing Products means the inventory of those Licensed Products existing as of the date hereof and included in the SpinCo Assets.

Existing Products means any Avise PG Product, Avise MCV Product or CB-CAPS Product.

Existing Products means all Products referred to in clauses (a), (b) and (e) in the definition of Covered Revenues as in existence as of the Closing Date, to the extent regulatory approval and clearance is applicable, including Galleri multi-cancer early detection test, DAC diagnostic aid for cancer test and the Minimal Residual Disease Test.

Existing Products means, collectively, the Acticoat Product, the Acticoat 7 Product, the Acticoat Absorbent Product, the Acticoat Moisture Control Dressing Product, the Acticoat Polyurethane Films, the Acticoat Site Dressing Product and the Acticoat Post-OP Product;

Existing Products means Abbott Existing Products and Applera Existing Products.

Existing Products means: (i) those products set forth on Section 2.4(c) of the Disclosure Schedule, which lists all products: (A) that have been sold by the Business in commercial quantities at any time since January 1, 2008; and (B) other historical products of the Business for which Purchaser is assuming certain Assumed Liabilities as set forth in Section 2.4(c); and (ii) those other products set forth on Section 1.1(bb) of the Disclosure Schedule either actively in late-stage development by, or sold in less than commercial quantities by, the Business at any time since January 1, 2008. Purchaser acknowledges and agrees that prior to the Closing, Sellers shall update Section 1.1(bb) of the Disclosure Schedule to include any other products that become late-stage development products of the Business after the date hereof and prior to the Closing.

Existing Products means, when used in reference to a Party, the versions of the Party’s (and its current Controlled Affiliates’) products and services, whether or not customized for a particular environment or platform, that bear brands of the Party or its current Controlled Affiliates and that are or have been commercially available (as opposed to a beta or other version used primarily for testing and user feedback purposes prior to commercial availability) to Customers and/or Distributors on or prior to the Effective Date. A Party’s (or its current Controlled Affiliates’) branded product or service remains an Existing Product even if it is subsequently or jointly branded by a Distributor or Customer.
