RENTAL AGREEMENT TERMS AND CONDITIONS. If the Grantee is in default in its performance under any provisions of this agreement, the City may terminate this agreement without prior notice. Skating Parties, Lessons, Clinics, Curling and like activities – City will supply lighting, locker rooms as needed, and the ice surface. Hockey, Broomball, and like activities – City will supply lighting, two (2) nets, locker rooms as needed, scoreboard, and the ice surface. Admission Events – City will supply the same as listed in item #3 Grantee must request use of Meeting Room, if available, prior to rental of the arena, otherwise the Meeting Room will remain locked. The room may be rented for a fee. A supervising adult must be present in the room if utilized by youth. City is not responsible for any property or goods of Grantee or its invitees while on the premises. By the acceptance of this agreement, Grantee releases City from any and all damage to property or goods of the Grantee or its invitees which may arise from the use and occupancy of the premises. At the termination of this agreement, Grantee must remove from the premises all its property within a timeframe approved by the Arena Manager. City reserves the right to cancel all or portion of any rental under this contract by notifying the Grantee at least one (1) week in advance of the date and will provide a reasonable time and date in the season to reschedule cancelled hours. The purpose of this clause is to allow City to schedule and sponsor special events, tournaments, and games during hockey season. Any contracted hour which conflicts with any special event, tournament, holiday, etc., which management has scheduled before or after the signing of this contract shall cancel the agreement only for those hours that conflict, and the Grantee may, at their option, accept or reject substitute hours with a pro-rated refund if the substitute hours are rejected. Under certain weather conditions, City may declare conditions unsafe or unacceptable and cancel Grantee’s contracted ice time. This decision is at the sole discretion of the City or any authorized City employee. Should Grantee’s ice time be canceled due to weather, Grantee will receive a refund for the canceled ice time. If Grantee desires to cancel any or all contracted ice time, with less than a weeks’ notice, Grantee shall be responsible for the total payment of the cancelled ice time.
