EMPLOYEE ALCOHOL AND DRUG TESTING. The provisions of this section are intended to comply with alcohol and drug testing policy and procedures pursuant to the Federal Highway Administration’s final rule on alcohol and controlled substances testing of commercial motor vehicle drivers, as amended in the Federal Register. All employees subject to this policy remain subject to all other policies regarding the use and/or possession of controlled substances in the workplace. These employees also remain subject to all other relevant federal, state and local laws and regulations, including the driver disqualification and penalties. All alcohol and controlled substance testing shall be conducted in accordance with the Department of Transportation’s workplace drug and alcohol testing programs.

Related to EMPLOYEE ALCOHOL AND DRUG TESTING

  • Alcohol and Drugs Service Provider agrees that the presence of alcohol and drugs are prohibited on the Work Site and while performing their Services. If the Service Provider or any of their agents, employees, or subcontractors are determined to be present or with alcohol or drugs in their possession, this Agreement shall terminate immediately.

  • DRUG AND ALCOHOL TESTING Employees may be tested for drugs and/or alcohol pursuant to the provisions of the Employer's Drug and Alcohol Testing Policy which is attached hereto and made a part of this Agreement as if more fully set forth herein.

  • Drug Testing (A) The state and the PBA agree to drug testing of employees in accordance with section 112.0455, F.S., the Drug-Free Workplace Act.

  • Alcohol Testing Alcohol testing will be conducted by using an evidential breath testing device (EBT) approved by the National Highway Traffic Safety Administration. Non-EBT devices may be used for initial screening tests. A screening test will be conducted first. If the result is an alcohol concentration level of less than 0.02, the test is considered a negative test. If the alcohol concentration level is 0.02 or more, a second confirmation test will be conducted. Levels of .04 or greater on the confirmation test will be considered positive.
