Compensation for Overtime. Assigned overtime is designated as those hours over the regular hours of work which are requested of the employee by management. Assigned overtime worked shall be paid at the rate of time and one-half (1 1/2).

Hours worked in excess of forty (40) hours worked in a workweek or in excess of an employee’s regularly scheduled shift in a workday shall be compensated at one and one-half (1 ½) times an employee’s regular rate of pay. For example, employees assigned to a shift comprised of a four (4) day work week containing four (4) ten (10) hour work days shall be paid time and one-half for all hours actually worked in excess of ten (10) hours per day or forty (40) hours per week.

Compensation for Overtime. 23.5.1 Compensation may be taken in the form of either compensation in addition to regular compensation or as time off. However, the University's overtime compensation policy encourages Members to take time off in lieu of payment at a time that is mutually agreeable to the Member and the department. 23.5.2 Approved overtime will be compensated as follows:
(i) time off in lieu of payment or payment at one and one-half (1 ½) times the Member's regular hourly rate for all hours worked in excess of thirty-five (35) hours per week or seven (7) hours per day. 23.5.3 Overtime will be offered to the Members in the following order:
(i) if the work is already in progress, to the Member(s) already performing the work;
(ii) if declined under (i) or if it is work not yet assigned, it will be equitably offered to qualified Members under the direction of the immediate supervisor in order of seniority on a rotational basis;
(iii) if the work is still unassigned, then to qualified Members in the department in which the work originates.
23.5.4 The departmental record of overtime will be made available upon request.
23.5.5 Members shall record overtime on the WLUSA Supplemental Pay Form and submit the form to their manager in the pay period it is worked. The manager shall forward the completed form to Payroll prior to the next pay period.

Compensation for Overtime. Compensation is defined as either cash payment or compensatory time off, or a combination of cash payment and compensatory time off, in accordance with the overtime code for the employee's class. Employees shall have their overtime hours computed as follows: Code “N” – (FLSA Covered) Employees covered by FLSA are eligible for overtime at time and one-half cash or compensatory time off. The appointing authority shall grant the request if it meets the operational and/or funding needs of the Department. The decision of the Appointing Authority or Designee is final. An employee shall not be denied overtime opportunities due to requested preferences made pursuant to this section.

9.5.3 Compensation time off may be allowed in lieu of cash payment, if mutually agreed by both parties. Compensatory time off shall be earned at a rate of one and one-half times the regular rate. Compensatory time off shall not hinder the services rendered by the County Office of Education. Any dispute as to the hindrance of services shall be resolved by the Superintendent or designee. The employee may request compensatory time off in lieu of overtime payment and may be granted such time off with the approval of the employee’s supervisor. However, compensatory time off which is not taken shall be paid for in cash at the appropriate overtime rate, and at the employee’s rate of pay at the time payment is made. Any unused compensatory time as of October 31 will be paid in December. Any unused compensatory time as of May 31 will be paid in July.
9.5.4 At no time shall compensatory time be accrued in excess of ninety (90) hours. Any compensatory time in excess of ninety hours shall be paid to the employee during the next pay period after it was earned.
