Continuation of Rights and Benefits. An Employee receiving payment for a compensable injury under WSIB shall accumulate seniority and shall be entitled to all benefits under this Collective Agreement. While on WSIB, the Employer shall continue to pay their share of all premiums for Employee Benefit Plans, including the Pension Plan, based on 100 percent of earnings. Seniority lists posted under Article 12.02 shall continue to reflect an employee’s accrued seniority while she/he is away from work due to illness or disability, subject to 12.04 (8) above.

While an employee is receiving WSIB payments the Employer shall continue to pay its share of all premiums for a maximum of twenty-four (24) months for Dental, Extended Health Care, LTD and Group Life benefits, providing the employee pays his/her share of the premium contribution if any,. The employee must continue to pay their portion of the LTD premium during their absence. An employee who has filed a WSIB claim will be paid the approximate equivalent of the WSIB payment through payroll, pending the approval of the claim by WSIB. These payments and any necessary adjustments will continue for the duration of the claim. Should an employee in receipt of this payment from the Employer subsequently be denied coverage from WSIB the employee shall be entitled to make any claim under the sick leave plan she would have otherwise been able to make , from the date of illness/injury.
Continuation of Rights and Benefits. An employee receiving temporary or permanent disability benefits from the Long Term Disability Plan or the Workplace Safety and Insurance Board in consideration of an illness or injury sustained while employed by the Employer shall have right to reclaim the job being performed at the onset of disability or, if this job is no longer available, a comparable job at a comparable rate of pay. Such employee shall also be entitled to have his participation continued in the Employee Group Benefit Plans, as described in Article 24 hereto. An employee’s entitlement to the privileges set forth in this article shall be limited to a period of twenty-four (24) months from the onset of disability.
