Product Availability. The Insurance Companies have qualified the Products for offer and sale under the applicable insurance laws of various states and other jurisdictions. Producers and Registered Representatives shall solicit applications for the Products only in states and jurisdictions where such Products have been so qualified. Producers shall, upon request, be provided with a list of those states and jurisdictions in which the Products have been qualified for sale. The Insurance Companies shall file and make all statements or reports as are or may be required by the laws of such state or jurisdiction to maintain these qualifications in effect.
Product Availability. Under no circumstances shall Company be responsible to Representative or anyone else for its failure to fill accepted orders, or for its delay in filling accepted orders, when such failure or delay is due to strike, accident, labor trouble, acts of nature, freight embargo, war, civil disturbance, vendor problems or any cause beyond Company's reasonable control.
Product Availability. Contractor must agree that there will be no cancellation of products used without an equal and acceptable replacement approved by the Contract Administrator during the term of the agreement. Contractors must communicate manufacturer’s discontinuation of any products to the Procurement Officer in writing within five (5) business days. In such instances, Contractors shall work with the Procurement Officer to identify and implement alternative options that shall maintain or reduce costs associated with the replacements. Contractors must be prepared to offer suggested replacement of discontinued products at least 30 days prior to substitution, including replacement part number, description, list price, applicable discount, and final price. Substitutions shall not be made without the full knowledge, evaluation, and agreement of the Procurement Officer as evidenced by a written contract modification.

Product Availability. Krown Lab, Inc. makes every effort to ensure that your product is shipped according to the estimated lead times provided at the time of purchase. The estimated lead times are in business days (Monday through Friday, excluding federal holidays). Although Krown Lab, Inc. makes every effort to ensure shipment of your order according to the lead time provided, shipping dates may change due to changes in supply. If the lead-time changes, Krown Lab, Inc. will contact you and provide a revised shipping estimate. PRODUCT DELIVERY Buyer must be able to provide means of receiving the delivery of items, which may require a forklift. Once an item leaves ours warehouse we are unable to prevent delays by the freight carrier. It is the Buyer’s responsibility to coordinate acceptance or pick-up of items upon attempted delivery. Any costs or expenses incurred by Krown lab, Inc. as a result of the Buyer’s failure to accept or pick-up the items will be charged to the Buyer. When receiving your items please check the condition of the item and make note of any damage before signing the bill of lading. The shipper is only responsible for damages noted on the bill of lading. Any damages not noted will not be covered by the shipper. If an item is severely damaged at the time of delivery, please refuse delivery. Krown lab, Inc. shall not be responsible for in transit damages, shortage or loss, unless solely caused by Krown lab, Inc., both Krown Lab, Inc. and the carrier(s) are notified within one day of receipt of Products, the Products have been signed for as “damaged”, or “not examined”, and have been handled by the Buyer in accordance with the carrier’s conditions of use. Products supplied and delivered for installation shall be checked by the Buyer against relevant specification before installation, and Buyer shall immediately notify Krown Lab, Inc. of any items found to be incorrect or defective so that Krown lab, Inc. may replace same before installation. Krown lab, Inc. shall be responsible for charges or for any cost incurred in dismantling incorrect or defective items. For all Products delivered to Buyer directly from Krown lab, Inc.’s Manufacturing Partners, Krown lab, Inc.’s involvement, liability, and responsibility ends once Product(s) is in transit to Buyer. The only exception to the aforesaid is if Krown Lab, Inc. has incorrectly relayed Buyer’s specifications to the Manufacturing Partner. Buyer is therefore in all other cases to communicate directly and exclusively...
Product Availability. Buyer acknowledges that the Product supplied under this Contract is a co-product of Seller’s cracking operation for the production of Ethylene and Propylene. In the event that Seller decides at any time to reduce its cracking operation for any reason, the quantity specified in this Contract may be reduced at Seller’s option without any liability to Seller. In the event that Seller elects at any time to change the feedstock for cracker operation which reduces the co-product production, the quantity specified in this Contract may be reduced at Seller’s option proportionally to the reduction of the co-product production without any liability to Seller.

Product Availability. AltiGen will use reasonable efforts to fill orders for Products and meet requests for shipment dates subject to Product availability and AltiGen production and supply schedules. Should orders for Products exceed AltiGen' available inventory, AltiGen will allocate its available inventory and make deliveries on a basis AltiGen deems equitable, in its sole discretion, and without liability to Distributor on account of the method of allocation chosen or its implementation. AltiGen shall not be liable to Distributor or any third party for any damages due to AltiGen' failure to fill any orders or for any delay in delivery or error in filing any orders for any reason whatsoever.

In such situations, Young Living will attempt to notify you of the change and will continue to send the remaining items. It is your responsibility to verify that the products in your order are available when shipped. You are responsible for maintaining your qualifying PV.
