Other Material definition

Other Material means non-degradable construction or demolition waste, such as masonry rubble, concrete rubble and asphalt;
Other Material means degradable or non-degradable construction or demolition waste such as masonry rubble, concrete rubble, asphalt and contaminated soils regulated under the Waste Management Act, RSBC 1979, c. 428.5, as amended. Individual pieces of such waste shall not exceed 1 metre in length nor 1 cubic metre in volume;
Other Material refers to the pre-existing musical material which is used or embodied in a Master Recording intended to be a "Master"; and the term "Sampled Master" refers to a Master Recording which is delivered to us as a "Master" subject to this Contract embodying Other Material. You warrant, represent, covenant and agree as follows: concurrently with your delivery to us of any Master Recording as a "Master" subject to this Contract, you shall notify us in writing of any Sampling of Other Material in that Master Recording, and you shall notify us in writing of the names and addresses of the recording artist(s), recording companies, songwriters and publishers who have any right, title or interest in and to the Other Material embodied in that Master Recording intended to be delivered to us as a "Master" subject to this Contract as a result of that Sampling; no Sampled Master shall violate or infringe on the rights of any other person, firm or corporation, including, without limitation, the copyrights owned or controlled by any other person, firm or corporation; as between you, on the one part, and us, on the other part, you shall be solely responsible for and shall account for and pay to the persons, firms or corporations that own or control Other Material all monies to which those other person, firms or corporations are entitled to as a result of the Sampling of any Other Material in Sampled Masters subject to this Contract; and, as between you and us, you shall be solely responsible for obtaining all consents and licenses necessary or desirable in connection with the use and reproduction and licensing the use and reproduction of Other Material in Sampled Masters. No royalties, advances or other money shall be earned by or payable to you hereunder in connection with any Sampled Master and no Sampled Masters shall be deemed to be delivered to us in fulfillment of your Recording Commitment unless and until we obtain documentation reasonably satisfactory to us of the foregoing. Examples of Other Material in a sentence

  • For Other Material, as defined by this Contract, the minimum stumpage for purposes of penalty shall be $10.00 per ton or the Contract stumpage rate multiplied by 3, whichever is higher.

  • Other Material that has been manufactured by the Purchaser shall be decked and hauled separately from sawlogs.

  • Butt cut logs (the first log cut above the ▇▇▇▇▇) that meet LOG MANUFACTURING AND RECOVERY STANDARDS in Table 2, but do not meet TREES DESIGNATED FOR CUTTING minimum top DIB and length, may be considered as Other Material, not sawlogs.

  • The Forest Improvement fee is not included in Other Material penalties.

More Definitions of Other Material

Other Material collectively and individually means all Material that is not Specified Material.
Other Material means but is not limited to construction or demolition waste, masonry rubble, concrete, asphalt, unchipped lumber, drywall, biological waste, glass, plastic debris, tree stumps, and woodwaste.
Other Material means any material not classified as soil that is deposited on land for any purpose including soil consolidation.
Other Material has the meaning given to it in Section 4.2.1
Other Material will mean a Master Recording (or the musical composition recorded therein) which is owned or controlled by a Person other than Artist. Without limiting anything contained herein, no Master will be deemed delivered to Label hereunder unless Artist has obtained all consents and licenses which Label deems necessary in connection with the use and reproduction of Other Material as reproduced therein (including, without limitation, written clearances or licenses for the perpetual, unrestricted right throughout the Territory to reproduce and otherwise exploit the Other Material in the Master in question and all information pertaining to credit copy required by the copyright holder(s) of the Other Material in the Master in question), all of which will be secured prior to Label authorizing the mastering of the Master in question. Artist will notify Label of any Sampling and of the names and addresses of the recording artist(s), record companies, songwriters, publishers, and other Persons who have any right, title or interest in any Other Material. As between Artist and Label, Artist will be solely responsible for and will account for and pay to the Persons that own or control Other Material all monies to which those Persons are entitled as a result of the Sampling of any Other Material in any Master, provided Label may in its sole discretion agree to account and pay such Persons as an accommodation to Artist upon Label’s receipt of a letter of direction, substantially in the form of Exhibit C. No monies will be earned by or payable to Artist in connection with any Master containing Other Material unless Label obtains documentation reasonably satisfactory to Label to effectuate the foregoing. Nothing contained in the foregoing will limit or waive any of Artist’s warranties, representations or indemnities hereunder.
Other Material means any waste designated by the Authority to be Acceptable Waste but which requires uniform, separated delivery and special handling by the Authority. Examples include tires, brush, white goods, and electronics.

The individual size of such pieces shall not exceed one (1) metre in length or not more than one (1) cubic metre in volume.
