Out of Classification. An employee temporarily assigned the full duties and responsibilities of a higher salary level position for more than five (5) days shall be paid five percent (5%) above his/her hourly rate or the first step of the higher classification, whichever is the greatest, retroactive to the first day of the temporary assignment. An exception is Head Cook positions in Food Services. Anyone working in a Head Cook position, from the first hour will be paid the additional five percent (5%).

The employee will be paid at the 11 first STEP of the higher paid classification that provides an increase of at least five (5) percent above 12 his/her base hourly rate of pay for the hours so assigned. In the event that the employee works out- 13 of-classification in excess of thirty (30) continuous days, all compensated hours will be in accordance 14 with Article 15 of the MLA at the higher rate of pay. Such assignments will not be used to supplant 15 positions or violate Union jurisdictional rights. An employee assigned by the manager/designee to 16 perform the duties of a lower paid classification on a temporary basis will not have a reduction of 17 wages.
Out of Classification. Out-of-classification assignments are made by management in consultation with the affected employee. Prior approval is required by the immediate supervisor, department manager, and the Associate Vice Chancellor of Human Resources. Out-of-classification is defined as performing 100% of the duties in a higher level classification. A worker may be assigned duties in a higher level classification and still continue to perform some or all of the duties in the worker’s regular classification. For clarity and distinction, this is considered additional duties assigned, not out-of-classification work. The worker will be compensated accordingly, but the additional pay will not be reportable under CalPERS rules and regulations.
