Contractor Services and Responsibilities. The attached Scope of Services Addendum (“Scope of Services”) sets forth the specific activities Contractor must perform for the Department pursuant to this Agreement. The examination work performed pursuant to this Agreement, as further detailed in the Scope of Services, must be performed by Contractor or sub-consultants that are pre- approved by the Department. The attached Scope of Services will be enforceable in accordance with its terms and the terms of this Agreement.

Contractor Services and Responsibilities. 2.1General Description Contractor’s Scope of Work shall be carried out in full compliance with the requirements contained in and necessarily inferable from the Contract Documents, including but not limited to the terms and conditions in this ARTICLE 2. The Contractor shall perform all of its services and the Work in compliance with Applicable Laws, such that the Project, when completed, will comply with Applicable Laws, shall supervise and direct the Work, using the Contractor's best skill and attention, shall perform the Work in a good and workmanlike manner and in the most expeditious and economical manner consistent with the interests of Owner, shall exercise the degree of care, skill and diligence in the performance of the Work in accordance with and consistent with industry standards for similar projects and circumstances, shall utilize its best skill, efforts and judgment in furthering the interests of Owner, and shall furnish efficient business administration and supervision (the Contractor’s “Standard of Care”). In fulfilling its responsibilities, Contractor shall furnish, coordinate, manage and pay for, subject to Articles ARTICLE 13 and ARTICLE 14, all services and personnel necessary to: .1Construct the Project in accordance with the Contract Documents; .2Cause the Work to be performed in compliance with: (a) the Contract Documents, and (b) all Applicable Laws, including those relating to environmental protection, asbestos and hazardous materials and safety, subject to and consistent with the provisions of Section 11.2; .3Provide the services of all senior managers, Site supervisors, skilled CPM scheduling personnel, foremen, skilled and unskilled craft labor, and all other personnel necessary to plan and construct the Work; .4Provide the services of buyers, expediters and other personnel necessary to achieve the timely delivery and use of all materials, supplies and equipment to be incorporated into the Work; .5Provide the services of buyers, expediters and other personnel necessary to achieve the timely delivery and use of all construction machinery and equipment, tools and expendable construction materials and supplies necessary for the Work; .6Prepare and provide Contractor's Base-Line Schedule, Schedule Updates and Revised Schedules for the Work in accordance with ARTICLE 6; .7Coordinate the schedules and operations of all Subcontractors and Vendors of every tier and cooperate with Owner and Owner’s other contractors so that the Contractor'...

  • Contractor Responsibilities 19.1. Contractor shall perform national criminal history checks for Ohio, Indiana, and Kentucky, and 10-panel drug screening tests on all prospective employees performing work under this RFP or coming onto a CMHA property and any resulting contract and provide summaries of the results to the Authority if requested. For the purposes of this section, the term “employees” includes contractor. Prospective employees whose criminal background check discloses a misdemeanor or felony involving crimes of moral turpitude, sexual offenses or harm to persons or property shall not be employed to perform work under this RFP or any resulting contract. Contractor is required to perform drug screening of all employees and to ensure acceptable test results. Criminal history and drug screening checks will be completed at the sole expense of the contractor. Any employee of the Contractor suspected of being under the influence of drugs and or alcohol will be reported to the appropriate personnel at CMHA and/or other local law enforcement. If the employee is determined to be under the influence of drugs or alcohol in any form or manner, or believed by proper authority to be dealing in illicit sale of alcohol or drugs they will be removed and shall not be allowed to return to any job site on the Authority’s property. The Contractor’s contract may be suspended and/or terminated should such a situation occur or if the Contractor fails to submit results pursuant to this section.

  • Roles and Responsibilities 1. The Donor States shall make funds available in support of eligible programmes proposed by the Beneficiary State and agreed on by the Financial Mechanism Committee within the priority sectors listed in Article 3.1 of Protocol 38c and the programme areas listed in the Annex to Protocol 38c. The Donor States and the Beneficiary State shall cooperate on the preparation of concept notes defining the scope and planned results for each programme.
