Other Modifications. With respect to the Securities of this series, the Indenture shall be modified as follows:

In the event of energy shortage, severe weather, or other emergency, the School Board may modify the duty day or duty week, with the understanding that the total number of hours will not be increased, i.e., a four (4) day week with increased hours per day, but the total weekly hours not more than the regular five (5) day week.

Other Modifications. A Member's Modified Base Year Volume shall be increased by the volume of Designated Products sold in the most recently completed year under any unassignable contract upon the earlier of the assignment to the Company or the expiration of such contract.
Other Modifications. The Original Loan Documents shall be deemed to have been modified and supplemented as expressly set forth in this Agreement, including by the New Documents described below. However, except as otherwise expressly so amended or supplemented by New Documents, the Original Loan Documents remain in full force and effect.

The Parties specifically intend and acknowledge and agree that, except as otherwise expressly provided in this Agreement, (a) this Agreement shall not be subject to amendment or other modification, absent the written agreement of both Parties and (b) neither Party shall be permitted to make a filing with FERC under any provision of the Federal Power Act or the regulations promulgated thereunder that seeks to amend or otherwise modify, or requests FERC to amend or otherwise modify, any provision of this Agreement at any time during the Term, except to implement an amendment or other modification to this Agreement that has been reduced to writing and signed by both Parties. In addition, to the extent any third party, or FERC acting sua sponte seeks to amend or otherwise modify, or requests FERC to amend or otherwise modify, any provision of this Agreement, the standard of review for any proposed amendment or other modification shall be the "public interest" standard of review set forth in United Gas Pipe Line Co. v.
Other Modifications. For the avoidance of doubt, this Agreement does not address the parties' respective rights and obligations with respect to those components of Eurex Release 4.0 and Eurex Release 4.1 which are not 4.0 Modifications or 4.1 Modifications or the Modifications known as Eurex Release 3.0, JV Release 1.0 and JV Release 2.0
