Transfer Out of the Unit. Any employee who is transferred out of this bargaining unit into a classification in the COAM (Command Officers) bargaining unit or who is appointed to a non-union administrative position in the Monroe County Sheriff’s Office, shall retain his or her seniority within the job classification held at the time of such promotion and/or appointment. In the event that he vacates that position, he may exercise his seniority and return to the bargaining unit. This provision shall not apply to transfers out of the bargaining unit to any other positions.

Transfer Out of the Unit. Any employee who is transferred out of this bargaining unit into another position within the Central Dispatch shall have their bargaining unit seniority frozen. In the event he is laid off or demoted from the position outside the unit, he may exercise his seniority to return to the bargaining unit. An employee awarded a transfer or promotion to another position within the Central Dispatch may elect to return to his former position and rate of pay during the probationary period of the new position. All employees promoted to the position of Communications Supervisor from Communication Specialist shall serve the probationary period as provided in that agreement. If, in the opinion of the Employer, they do not successfully complete their probationary period, they shall revert back to their previous job classification without recourse to the grievance procedure. Any such promoted employee shall also have the option of voluntarily reverting back to their previous job classification if they so indicate in writing to the Employer during their probationary period.
Transfer Out of the Unit. Any employee who is transferred out of the bargaining unit covered by this Agreement, but who continues as an employee of the County Sheriff's Office, shall retain his seniority within the job classification held at the time of such transfer. If the employee vacates that position, or the Employer decides to remove that person for any reason other than termination for cause, he may exercise his seniority and return to the bargaining unit.

In the event he is laid off from the position outside the unit, he may exercise his seniority to return to the bargaining unit. In the event he is forced to revert to his previous position in the bargaining unit he shall carry full seniority credit from his original date of hire with the Sheriff’s Office including all the time spent in the Administrative position.

Any employee who is transferred out of this bargaining unit into another position within the Corrections Division of the Sheriff’s Office shall retain his seniority within the job classification held at the time of such promotion. In the event he is terminated from the position outside the unit for reasons other than misconduct, he may exercise his seniority to return to the bargaining unit.

An employee who chooses to accept an appointment by the Sheriff to an administrative position within the Corrections Division shall be allowed to return to this bargaining unit if the employee vacates the appointed position, either voluntarily or involuntarily, for reasons other than misconduct. The employee accepting the appointment shall not forfeit bargaining unit seniority and shall accrue seniority while appointed to the Administrative position. If the employee returns to the bargaining unit he shall be placed on the seniority list and wage schedule without reduction for time spent in the Administrative position. If there is no vacancy when the transfer occurs, the returning employee will be allowed to bump the least senior employee.
Transfer Out of the Unit. At the option of the Employer, employees outside the bargaining unit may enter or re-enter the bargaining unit in their former or another position as long as it does not displace any current bargaining unit employee. If they are returned to their former or another position, Job Classification seniority for the period they worked outside the bargaining unit shall not be counted in calculating job seniority, but Job Classification seniority accumulated before the transfer shall be retained. If any employee decides to transfer out of the bargaining unit, he must return within thirty (30) days to keep his seniority.

Transfer Out of the Unit. If an employee transfers to a temporary assignment outside of the bargaining unit not exceeding six (6) months’ duration, she or he shall continue to accumulate seniority, service and benefits during this period and will be returned to a position in the bargaining unit without any loss of seniority, service or benefits.
