Engineering Employees. Schedule 7.2 sets forth a list of NetIQ's current engineering employees who have substantial familiarity with the Chariot Products, which list shall include Xxxx Xxxx. Ixia shall have the right to seek to interview and seek to employ such employees after the Effective Date; provided, however, that Ixia shall not employ more than three such employees, consisting of a maximum of two employees with responsibility for development and one employee with responsibility for quality assurance. NetIQ agrees not to solicit such employees with counter offers or other enticements. Once Ixia has employed any three such employees, Ixia agrees not to solicit for employment, nor hire for employment as a regular employee or contract employee, or an independent contractor, any other employees on the aforementioned list for a period of two (2) subsequent years, except that the foregoing restriction shall not apply to any person who at the time of the first communication (direct or indirect) with Ixia concerning such employment; (i) is no longer an employee of, and is not otherwise providing services to, NetIQ; (ii) has had no communication with Ixia, directly, through an intermediary or otherwise indirectly, concerning the possibility of employment (for purposes of the foregoing, any employment information published to the software engineering community generally, or to the public at large, shall not be considered a "communication" so long as Ixia did not, either directly or through any intermediary, make any effort specific to such former employee to cause such information to come to the attention of such former employee). If Ixia is unsuccessful in its efforts to employ at least one designated engineer, NetIQ will make available to Ixia, on Ixia's premises, one or more qualified engineers for up to 32 person-weeks. If Ixia is able to employ only one designated engineer, then NetIQ will provide up to 16 person-weeks. Ixia will reimburse the cost of all travel, lodging, etc., incurred by NetIQ in providing such services, while NetIQ will be responsible for the cost of salaries.
Engineering Employees. The employees covered by this Agreement will continue to work under the provisions of their relevant Awards (as described in Clause 5 hereof) in relation to their hours of work.
Engineering Employees a) All time worked in excess of that provided for in clause 6.1 (Hours of Work) or before the ordinary starting time or after the ordinary ceasing time shall be deemed overtime each day to stand by itself when overtime is being computed, except where an employee commences overtime on one day and continues to work such overtime into the next day.

Engineering Employees. Shall normally work from 7:00 a.m. to 3:30 p.m., Monday to Friday. All of the above winter schedule shifts include a one half (1/2) hour unpaid lunch break. It is desired that the hours of work for Engineering employees be flexible and as mutually agreed to between the employee(s) and the Department Manager. In the absence of agreement on flexible hours, the current Article provisions would prevail.

  • Transportation for Employees Transportation will be provided to employees who are required to work other than their normal working hours, and who must travel to or from their home during the hours between 11:30 p.m. and 6:00 a.m. and when convenient public transportation or other transportation facilities are not available. An employee shall be reimbursed for the cost of commercial transportation within their headquarters area, upon presentation of receipts.

  • Contractor’s Employees B7.1 The Council reserves the right under the Contract to refuse to admit to, or to withdraw permission to remain on, any premises occupied by or on behalf of the Council:

  • Newly Hired Employees All employees hired to an insurance eligible position must make their benefit elections by their initial effective date of coverage as defined in this Article, Section 5C. Insurance eligible employees will automatically be enrolled in basic life coverage. If employees eligible for a full Employer Contribution do not choose a health plan administrator and a primary care clinic by their initial effective date, and do not waive medical coverage, they will be enrolled in a Benefit Level Two clinic (or Level One, if available) that meets established access standards in the health plan with the largest number of Benefit Level One and Two clinics in the county of the employee’s residence at the beginning of the insurance year. If an employee does not choose a health plan administrator and primary care clinic by their initial effective date, but was previously covered as a dependent immediately prior to their initial effective date, they will be defaulted to the plan administrator and primary care clinic in which they were previously enrolled.

  • Supervisory Employees For the purposes of this Article, the parties agree that Supervisory positions are those that are not excluded under Article 2.0 above and that satisfy the following criteria:

  • Shift Employees Employees who work rotating shift patterns or those who work qualifying shifts shall be entitled, on completion of 12 months employment on shift work, to up to an additional 5 days annual leave, based on the number of qualifying shifts worked. The entitlement will be calculated on the annual leave anniversary date. Qualifying shifts are defined as a shift which involves at least 2 hours work performed outside the hours of 8.00am to 5.00pm, excluding overtime.   • Authorized Employees Contractor acknowledges that Section285.530, RSMo, prohibits any business entity or employer from knowingly employing, hiring for employment, or continuing to employ an unauthorized alien to perform work within the State of Missouri. Contractor therefore covenants that is not knowingly in violation of subsection 1 or Section 285.530, RSMo, and that it will not knowingly employ, hire for employment, or continue to employ any unauthorized aliens to perform work on the Project, and that its employees are lawfully to work in the United States.

  • Maintenance Employees The normal hours of work for full-time Maintenance employees are 72 ½ hours over a two (2) week period, not to exceed eight (8) hours per day.
