Subsequent Years. Notwithstanding anything in the Compact to the contrary, the Regulatory Fees for all class III activities under the Compact, including those applicable to the activities described in this Appendix (except for the first year fees set by estimate as provided in Sections 13.4.1 and 13.4.2, shall be set by determining the actual cost of regulating all of Tribe’s class III activities in the preceding year and setting and adjusting the coming year’s Regulatory Fee based thereon. If the previous year’s Regulatory Fee exceeded the SGA’s actual cost of regulation, any excess which was paid will be applied as a credit to the payment of Regulatory Fees in such next year. In the alternative, the Regulatory Fee may be set by agreement between the Tribe and the SGA reached through good faith negotiations commenced at the request of the Tribe, the terms of which may include a fixed amount without subsequent adjustment if both parties, at their sole discretion, agree.
Subsequent Years. If the building staffing allows, the job share can be dissolved. Employees may return to their original FTE/ness in their original building without applying for a position for which they are qualified.
Subsequent Years. For subsequent years (after the initial first year), until such time as the school meets the District’s exit criteria for schools having two (2) or more consecutive grades of “D,” or an “F” Priority School: Teachers with an overall Effective or Highly Effective evaluation for the previous year may apply, transfer, or be assigned to schools having two (2) or more consecutive grades of “D,” or an “F” Priority school. Those teachers with less than an overall Effective evaluation for the previous year who have been given notice of performance concerns and ample opportunity to improve, as per Teacher CBA Article 15 and the Instructional Evaluation System manual may volunteer to be displaced, be involuntarily transferred or terminated according to the appropriate provisions of the Collective Bargaining Agreement.
Subsequent Years. Following the first full year of employment, members of the MPFA will accrue vacation time as follows: 1 year to 5 years 96 hours 5 years to 10 years 144 hours 10 years and over 192 hours
Subsequent Years. Thereafter, for so long as this Agreement is in effect, Licensee shall pay annually to UTILITY, when billed, the Annual Fees for each Attachment increased by three percent (3%).
Subsequent Years. For calendar years after 2015, the minimum spending commitment (which will be subject to Section 8.1.4 below) will be negotiated and mutually agreed by the Parties in June of the preceding year (e.g., the minimum spending commitment amount for 2016 would be negotiated in June 2015), taking into account appropriate factors and considerations, including appropriate growth rates.
Subsequent Years. For years 6-20 of the Lease, LESSEE shall pay a ground rent of $25,000.00 per year, payable in equal monthly installments of $2,083.34 and shall pay all utility costs for the Leased Premises.
Subsequent Years. The annual leave entitlement is 36 days, (37 days for employees with 10 years’ service or over) inclusive of bank holidays (see section 11 for details) Staff working to a roster where the average turn length turn exceeds 8 hours, shall have their annual leave entitlement adjusted in proportion as follows: 0-10 years’ service 10+ service
Subsequent Years. Subject to Sections 5.2(c) and (d), XOMA will manufacture and supply to Onyx, and Onyx will order and purchase, a guaranteed minimum of [*] Batches at Commercial Scale during each twelve (12) month period during the term of this Agreement (including without limitation any term extensions pursuant to Section 11.1), commencing on an anniversary of the Attainment of Commercial Scale, or, for any period of less than twelve (12) months at the end of such term, a number of Batches equal to [*] multiplied by a fraction equal to the number of months in such remaining period divided by 12, with any fraction to be rounded up or down to the nearest whole number and fractions of 0.5 to be rounded up to the next whole number.
Subsequent Years. For all years during the Agreement Term subsequent to the Launch Period (“Subsequent Years”), Odyssey shall provide Indevus with a non binding rolling three year forecast (broken down by month for the initial 12 months of each such forecast). Except for the first 12 months of such three year forecast, it will not be binding in any way. Each forecast shall update the forecast on a rolling monthly basis, and shall supercede any previous forecast of the Annual Forecast Amount for each of such Subsequent Years, except that it shall not alter or effect the [*] percent ([*]%) minimum purchase requirement of earlier forecasts for any particular Subsequent Year. Accordingly, the Annual Purchased Amount for any Subsequent Year shall be at least [*]% of the Annual Forecast Amount set forth in the initial Odyssey forecast for such Subsequent Year.
