AND JURISDICTION. 1.1 The Employer hereby recognizes the Union as the exclusive bargaining agent for all Employees who perform work within the scope of this Agreement and the Union recognizes the Associations as the bargaining agents for any contractor who assigns its bargaining rights to an Association, and any independent contractor who signs this Agreement or otherwise agrees to be bound by it and who employs Employees within the territorial jurisdiction of the Union as set forth in this Article I unless such independent contractor has given proper notice under paragraph
AND JURISDICTION. (a) The employer voluntarily recognizes the Union as the sole bargaining agent for all its employees in the Airport, save and except Supervisors and persons above the rank of Supervisors. The Employer recognizes the Union as the sole bargaining agent for the employees who are or will be unionized. An employee promoted to a position excluded from the bargaining unit shall not accumulate seniority during absence from the bargaining unit. In the event the employee bids for and is awarded a job posting back within the bargaining unit will be entitled to seniority accumulated up to the day in which was promoted to a position excluded from the bargaining unit. The Employer agrees that an employee may elect to return to former position within the first thirty-day (30) period, thereafter may return to a vacancy within the bargaining unit as a new employee.
AND JURISDICTION. The Company recognizes the Union as the sole bargaining agent for those employees at Canada Corp. Plant, covered by the Certification and working at the classified occupations listed in Appendix "A", and for such other employees as may be assigned to new classifications coming under the Union's jurisdiction, save and except assistant supervisor, persons above the rank of assistant supervisor, security guards, office, clerical and sales staff.
AND JURISDICTION. (a) The Employer recognizes the Union as the sole collective bargaining agency for all the employees of Abitibi-Consolidated Inc., Woodlands Division, including ail employees on the seniority of Consolidated Inc., in xxxxx operations on the Grand Falls timber limits save and except Woodlands Manager, Assistant Woodlands Manager, Superintendents, Assistant Superintendents, General Foremen, Foremen, Assistant Foremen, Scalers, Assistant Scalers, Technical, Clerical and Office Staff, Guards, Gatekeepers, Non-Working Contractors, Non- Working Sub-Contractors, persons employed in Silviculture operations, persons employed in supervisory, advisory and confidential capacities. Members of the Union who are promoted outside the Union will retain seniority and accumulated seniority for a period not exceeding three (3)
AND JURISDICTION. Section 7.01 - Indemnity. XXXXXX and XXXXXXXX agree to mutually indemnify one another and save harmless one another against all losses, costs or Humftggs arising out of any injury to persons or property occurring in the performance of this Agreement, or resulting from the failure ofthe Joint Conveyance System to function properly from any cause except due to negligence.
AND JURISDICTION. This Agreement shall be governed in all respects by and interpreted in accordance with the laws of the State of Arizona. Each of the Parties hereto consents to such jurisdiction for the enforcement of this Agreement and matter; pertaining to the transaction and activities contemplated hereby.
AND JURISDICTION. This Agreement shall be governed in accordance with the laws of the Commonwealth of Pennsylvania without giving effect to any choice or conflicts of law for any action at lawsuit in equity or other judicial proceeding concerning the Agreement. The parties hereby agree to submit the exclusive jurisdiction and to venue in the Federal and State courts in the Commonwealth of Pennsylvania in Bucks County.
AND JURISDICTION. This agreement shall be governed by Indian Law and the courts of law in India will have exclusive jurisdiction in any matter arising from or relating to this Agreement to the exclusion of all other courts that may have had jurisdiction in the matter.
AND JURISDICTION. (a) The Company recognizes the Union as the sole collective bargaining agent for all its employees employed by the Company on its operations in Nairn Township. For the purpose of this Article, employees shall be all those employed on the job classifications set out on the Wage Schedule attached to and forming part of the Agreement, including those who are engaged onjob classifications which may be established and become part of the Wage Schedule during the term of the Agreement. This provision excludes: Shift Supervisor, persons above the rank of Shift Supervisor, Scalers, Office Staff and Security Personnel. The employees of contractors engaged on operations of the Company in Nairn Township shall be considered employees within the terms of this Agreement, save and except the employees of contractors and/ or contractors who are engaged to perform occasional special services not commonly performed by employees covered by the terms of this Agreement, employees of contractors where such contractors are engaged for the purpose of erecting structures and where such contractor is bound by an Agreement with a Union or Unions affiliated with a central labour body covering such work. The Union will be advised at least two (2) weeks in advance of any Company plans to "contract out except in the case of a genuine emergency. Upon request of the Union, the Company shall provide certificates of qualification to the Union of any contractor entering the property.
AND JURISDICTION. For the purpose of negotiation and application of this Collective Agreement, the Employer recognizes the University Part-time Faculty Association as the only official representative and the only negotiating body for all part-time faculty included in the certification issued by, the travail et de la on September (See Appendix A). For the purpose of administration of the Collective Agreement, unless otherwise stipulated, the Labour Relations Office shall act on behalf of the Employer. ARTICLE GENERAL RIGHTS
