BARGAINING AGENCY. Section 1: Recognition
BARGAINING AGENCY. 2.01 The Company recognizes and agrees that the Union is the sole bargaining agent for the employees of the Company employed at the place(s) set out in the certificate(s) of bargaining authority and at any other premises opened or taken over by the Company in British Columbia. 2.02 This Agreement shall be binding on the Company and the Union and their respective successors, administrators, executors and assigns and on each employee.
BARGAINING AGENCY. Section 1: The Company agrees to recognize and bargain with the duly elected bargaining representative on behalf of its Employees properly and duly certified under the appropriate regulations in effect from time to time. Section 2: The Party of the First Part agrees that the bargaining authority of the Party of the Second Part shall not be impaired during the term of this new collective agreement. The Party of the First Part agrees that the only certification they will recognize during the term of this new agreement is that of the Party of the Second Part unless ordered by due process of the law to recognize some other bargaining authority.
BARGAINING AGENCY. 1. The Company recognizes and agrees that the Union is the sole bargaining agent of the employees of Cache Creek Machine Shop Ltd., employed at the place set out in the certificate of bargaining authority and at any other premises opened or taken over by the Company in British Columbia. 2. This Agreement shall be binding on the Company and the Union and their respective successors, administrators, executors and assigns and on each employee. 3. Each employee covered by this Agreement shall, as a condition of employment and/or continued employment, be and remain or become and remain, a Union member in good standing for the duration of this Agreement or for the duration of his employment with the Company, whichever is shorter. Counting from the date he commences employment with the Company, each new employee will be allowed thirty (30) calendar days within which to make application to join the Union and tender the appropriate initiation fees. The Union shall have the exclusive right to determine who is a member in good standing. Should an employee at any time cease to be a member in good standing of the Union, the Company shall, upon notification in writing from the Union, discharge such employee forthwith. 4. The right to hire employees of its choice is vested exclusively in the Company, but when the Company requires new employees, it shall so notify the Union so that the Union may have the opportunity to provide the Company with suitable applicants. 5. The Company shall deduct from each new employee an amount equal to the Union dues, from the employee's first payroll cheque after completion of six (6) days of work in a calendar month and add that employee's name and the said amount to the closest applicable checkoff; i.e., if the checkoff for that month has not been remitted to the Union, it shall be added to that checkoff; if the month's checkoff has been remitted, it shall be added to the following month's checkoff and shown as the previous month worked.
BARGAINING AGENCY. The Employer recognizes the Union as the sole collective bargaining agency of all employees as set out in the Certification Order.
BARGAINING AGENCY. 2.01 The Company recognizes the Union as the sole collective bargaining agency for all regular employees excluding executive staff, sales and office staffs, foremen and buyers with respect to wages, hours of work and terms and conditions of employment. The Company recognizes the right of the Union to determine the standing of all members. 2.02 The Company agrees that all employees now members of the Union and all employees who become members of the Union shall remain members in good standing of the Union while employed by the Company during the life of this Agreement, as a condition of continued employment.

BARGAINING AGENCY. 2.01 The Employer recognizes the Union as the sole and exclusive Collective Bargaining Agency for all employees in the Zone 1 bargaining unit for the present and future Overwaitea Foods and Save-On-Foods stores owned and/or operated by the Employer in the Province of British Columbia, with respect to rates of pay, wages, hours and all other conditions of employment set out in this Agreement, save and except excluded personnel and employees under separate certificate. In future stores the Collective Agreement shall be binding on the parties effective the date of store opening. Zone 1 Bargaining Unit (includes the geographic area from Hope to Whistler) 2.01 The Employer recognizes the Union as the sole and exclusive Collective Bargaining Agency for all employees in the Zone 2 bargaining unit for the present and future Overwaitea Foods and Save-On-Foods stores owned and/or operated by the Employer in the Province of British Columbia, with respect to rates of pay, wages, hours and all other conditions of employment set out in this Agreement, save and except excluded personnel and employees under separate certificate. In future stores the Collective Agreement shall be binding on the parties effective the date of store opening.
BARGAINING AGENCY. (a) The Company recognizes the Union as the sole collective bargaining agency for all employees at its retail stores in Ontario, except the stores in the Regional Municipality of Ottawa-Carleton, save and except Assistant Store Manager, persons above the rank of Assistant Store Manager, Graduate and Undergraduate Pharmacists, including Pharmacy Interns and Apprentice Pharmacists, and Office Staff. (b) A person classified as a Management Trainee is a member of the bargaining unit until such time as the Company advises the Union that the trainee has successfully, or otherwise, completed his training which shall be done within nine (9) months of each trainee's commencement of training. The Union will be advised in writing of names of management trainees. The Management Trainee Program is implemented solely for training purposes, in order to provide future managers with hands on experience of working in a store. Prior to placing a Management Trainee in any store, the Company agrees to provide the union with the name, the duration of placement and the location of placement of the Trainee. The Company agrees that the Trainee’s hours are separate and over and above from the store departments’ allotment of scheduled hours. A Management Trainee placement at the store will not exceed nine (9) months duration. Any concerns about the operation of the Management Trainee Program may be brought to the attention of senior management, and a meeting will be convened to discuss them. (c) The Company agrees that stores shall be staffed by Assistant Store Managers on the following basis; All stores shall have one (1) Assistant Store Manager, unless, i. The store is open for greater than 100 hours per week or has front store sales volumes in excess of $100, 000.00 per week, in which case there may be two (2) Assistant Store Managers. ii The store is open for greater than 100 hours per week or has front store sales volumes in excess of $150, 000.00 per week, in which case there may be three (3) Assistant Store Managers. Assistant Store Managers shall not be used to the extent that they cause a reduction of hours of any bargaining unit employees. (a) The term full-time employee or full-time employees whenever herein used, shall mean employees scheduled to work a normal work week forty (40) hours per week.
