Voluntary Service Leave. To allow employees time off who are volunteer members of a federal, state, or local certified fire department, police department, or American Red Cross. The District will determine the length of time it will grant for such leave in each individual case. The District reserves the right to extend a given leave if it deems it desirable to do so. During the period of time in which an employee is on leave of absence, he/she shall accumulate service with the District. Any employee who fails to return to work upon conclusion of the agreed-upon leave of absence shall be considered to have voluntarily terminated his/her employment with the District, subject to the terms of section 22.4 of the SEIU agreement or 39.7 of the ATU agreement for non-probationary employees. Employees on leave of absence shall have the option to pay any costs involved into and continue to participate in Health & Welfare programs and life insurance.

The District may grant a leave of absence when an employee still has accrued leave in a leave bank(s), however the District shall require usage of all available accrued leave prior to granting leave without pay. The Parties agree that certain provisions of the AFSCME/eBART contract require clarification and the following provisions of the AFSCME/eBART contract shall, effective following ratification of this side letter, be modified as follows:

The Parties agree that certain provisions of the ATU/eBART contract require clarification and the following provisions of the ATU/eBART contract shall, effective following ratification of this side letter, be modified only as indicated below, with new text marked by underlining and text to be removed marked as stricken. Unless underlined or stricken, all pre-existing text is to remain unchanged.

Voluntary Service Leave. An Engineer may request time off for the purpose of volunteer service for emergency relief efforts. These relief efforts are for such instances as natural disasters or catastrophic events. Such voluntary service must be coordinated through a recognized service organization. An Engineer may use accumulated paid time off (vacation, personal days, or sick days), unpaid leave, or a combination of both. However, the use of, including the type of leave, is subject to final approval of the Company. It is expressly understood that the approvals herein are solely and exclusively made by the Company. The decision will be rendered by the Company within seventy-two (72) hours of the initial request.

Voluntary Service Leave. An employee may request up to two (2) years leave for voluntary service in any program sponsored by the government. Upon completion of such a leave of absence, the employee shall be returned to the position which (s)he formerly occupied, or to a similar position if his/her former position no longer exists. (S)he may be returned to active pay status prior to the originally scheduled expiration of the leave, if earlier return is agreed to by the County.
