RIGHTS AND OBLIGATIONS OF THE EMPLOYER. 27:1 Except where modified by the provisions of this Agreement, it is agreed that the employer, through the Superintendent of Schools and other designated administrative representatives, is vested with and retains the right to direct its employees, to hire, promote, transfer, assign, and retain employees within the Fairhaven Public Schools; to suspend, demote, discharge, or take other disciplinary action against employees for just and legal causes; to relieve teachers without professional status from duty at the end of the school year for lack of work, for inefficiency, failure to show adequate professional growth, or other legitimate reasons, without the necessity of having to state them formally; to maintain the efficiency of the operations entrusted to it; to determine the method, means, and personnel by which such operations are to be conducted; and to establish curricula and take whatever action may be necessary to carry out its mission of providing a quality educational program for the children of the Town of Fairhaven.

The Employer shall supply the technical medium, i.e. crude oil, necessary to run the trials and start/ups of all Appliances and to start-up the tanks; cooperation with the Contractor for the purpose of due performance of the Contract; providing the Contractor with all necessary authorisations; payment of Remuneration to the Contractor within the time limits and upon the terms and conditions stipulated in the Contract; provision of fire protection to the Contractor by the plant Firefighting Service in the course of welding works on live infrastructure facilities of the Employer in the course of implementation of the Contract; provision of author's supervision by Gazoprojekt within the scope of compliance of the Works performed with the Building Design; The Employer shall on its own prepare and ensure the interconnection of new sections of installations to live process pipelines, including: preparation of pipeline installations by technological drainage of crude oil from pipelines, implementation of technological intersections of existing pipelines, provision of protection of cut-off sections of pipelines and preparation thereof for further assembly works, assurance of fire protection by plant Firefighting Service of the Employer (ZSP-Xxxxxxxx) for the duration of interconnection.
