MAGISTRATE’S COURT JURISDICTION. The Parties hereto consent to the jurisdiction of the Magistrates' Court in terms of Section 45 read with Section 28 of the Magistrates’ Court Act of 1944 as amended. Notwithstanding the aforementioned, this shall not preclude either Party from approaching the High Court of South Africa for any relief sought.

MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any Court proceedings herein, the Parties hereby consent to the jurisdiction of any Magistrate’s Court having jurisdiction over the intended Defendant.
MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any proceedings arising out of this agreement, the parties hereby consent to the jurisdiction of the Magistrate’s Court and the Regional Court, otherwise having jurisdiction under Section 28 of the Magistrates’ Court Act 32 of 1944, as amended; notwithstanding that the proceedings would otherwise be beyond the monetary jurisdiction of the Magistrate’s or Regional Court. This clause shall be deemed to constitute the required written consent conferring jurisdiction upon the said Courts, pursuant to the Magistrates’ Court Act of 1944, as amended. Notwithstanding the aforegoing, this shall not preclude either party from approaching the High Court of South Africa for any relief sought.

MAGISTRATE’S COURT JURISDICTION. The Purchaser(s) hereby consents in terms of section 45 of the Magistrates Court Act 32 of 1944, as amended, to the Builder instituting any proceedings arising out of this contract in the Magistrates Court having jurisdiction in terms of section 28 of the Magistrates Court Act notwithstanding the fact that such proceedings are otherwise not within the jurisdiction of such court. The Builder however reserves the right in its sole discretion to institute any action arising from this Agreement in the High Court of South Africa.
