MAGISTRATE’S COURT JURISDICTION. The Parties hereto consent to the jurisdiction of the Magistrates' Court in terms of Section 45 read with Section 28 of the Magistrates’ Court Act of 1944 as amended. Notwithstanding the aforementioned, this shall not preclude either Party from approaching the High Court of South Africa for any relief sought.
MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any Court proceedings herein, the Parties hereby consent to the jurisdiction of any Magistrate’s Court having jurisdiction over the intended Defendant.
MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any proceedings arising out of this agreement, the parties hereby consent to the jurisdiction of the Magistrate’s Court and the Regional Court, otherwise having jurisdiction under Section 28 of the Magistrates’ Court Act 32 of 1944, as amended; notwithstanding that the proceedings would otherwise be beyond the monetary jurisdiction of the Magistrate’s or Regional Court. This clause shall be deemed to constitute the required written consent conferring jurisdiction upon the said Courts, pursuant to the Magistrates’ Court Act of 1944, as amended. Notwithstanding the aforegoing, this shall not preclude either party from approaching the High Court of South Africa for any relief sought.
MAGISTRATE’S COURT JURISDICTION. For the purpose of all or any proceedings hereunder, the Parties consent to the jurisdiction of the Magistrate's Court having territorial jurisdiction, notwithstanding that such proceedings are otherwise beyond its jurisdiction. This clause shall be deemed to constitute the required written consent conferring jurisdiction upon the said court pursuant to Section 45 of the Magistrate's Court Act of 1944. Nevertheless, either Party shall have the right at its sole option and discretion to institute proceedings in any other competent court with jurisdiction.
MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any proceedings arising out of this Agreement, the parties hereby consent to the jurisdiction of the Magistrate’s Court otherwise having jurisdiction under Section 28 of the Magistrates’ Court Act, No. 32 of 1944, as amended; notwithstanding that the proceedings are otherwise beyond the jurisdiction of the Magistrate’s Court, this clause 21 shall be deemed to constitute the required written consent conferring jurisdiction upon the said Court pursuant to Section 45 of the Magistrates’ Court Act, No. 32 of 1944, as amended. Notwithstanding the aforegoing, the SELLER shall have the right, at the SELLER’S sole option and discretion to institute proceedings in any other competent Court which may otherwise have jurisdiction.
MAGISTRATE’S COURT JURISDICTION. The Purchaser(s) hereby consents in terms of section 45 of the Magistrates Court Act 32 of 1944, as amended, to the Builder instituting any proceedings arising out of this contract in the Magistrates Court having jurisdiction in terms of section 28 of the Magistrates Court Act notwithstanding the fact that such proceedings are otherwise not within the jurisdiction of such court. The Builder however reserves the right in its sole discretion to institute any action arising from this Agreement in the High Court of South Africa.
MAGISTRATE’S COURT JURISDICTION. The Parties consent to the jurisdiction of the Magistrates' Court in terms of Section 45 read with Section 28 of the Magistrates’ Court Act of 1944 as amended. Nothing contained herein shall preclude a party from approaching a relevant division of the High Court should they deem it necessary.
MAGISTRATE’S COURT JURISDICTION. The parties hereby consent in terms of Section 45 of the Xxxxxxxxxx'x Xxxxx Xxx 0000 to the jurisdiction of any Magistrate's Court having jurisdiction over their respective person under Section 28 of the Magistrate's Court Act, notwithstanding that any action or proceeding arising out of this Agreement would otherwise be beyond the jurisdiction of such Court, provided that the Seller shall have the right to institute proceedings in any other Court of competent jurisdiction.
MAGISTRATE’S COURT JURISDICTION. For the purposes of all or any Court proceedings herein, the employer and contractor hereby consent to the jurisdiction of any magistrate's court having jurisdiction over the intended defendant.
MAGISTRATE’S COURT JURISDICTION. For the purpose of all proceedings hereunder the Subscriber hereby consents to the jurisdiction of the Magistrates’ Court, notwithstanding that the amounts claimed are beyond such jurisdiction, provided that COMTEL shall have the right at its sole option and discretion to institute proceedings in the High Court or any other competent Court or Forum.
