New Sections. Subject to Paragraph B above, it is agreed that if the class size maximum for any class is exceeded by 20% across all sections of a grade level, rounded to the nearest whole number a new section will be established unless other arrangements are made with the certified staff and the Union. Teachers designated to have the mainstream special education classroom shall have the smallest class size of that grade level in that subject area and shall not exceed the upper limits of the class range outlined above. It is further recognized that events may occur which threaten the financial stability of the school district and require the reduction of teaching staff. In such instances, the ranges may not be achievable and they shall not be applicable during periods of layoff. The Administration is willing to discuss with the Union how to avoid deviations from or minimize the effect of deviations from the ranges set forth above, but reserves the right to have final say on the matter based on the financial circumstances of the District. Such discussion should include, where appropriate, safety concerns, available resources and scheduling the use of resources. Further, and in the event a class size falls below the low number in a range set forth above, the Administration has the obligation and the right to decide the best course of action which could include cancellation, combination, reassignments and/or maintaining the status quo. The District shall document these financial shortcomings to the Union. The memorandum of understanding for the 2018-2019 school year will continue through the 2019-2020, 2020-2021 and 2021-2022 school years. Please see attached MOU in Appendix.
