Offsite Improvements. The Developer, at its own cost, shall perform and complete all off-site work and improvements consisting of streets, street name signs, traffic signs, sewers, water systems, fire hydrants, curbs, gutters, sidewalks, street lighting, driveways, drainage, rights of way, accesses, lawns, trees, shrubs, survey monuments, reference lines or points, etc., in accordance with currently applicable ordinances, regulations, standards and specifications, or other requirements of the City in the particular circumstances of the development herein specified.
Offsite Improvements. [If no offsite improvements are proposed, then delete the remainder of this section and insert N/A] Customer agrees to construct the System in accordance with the approved plans and specifications at its sole expense up to acceptance of the System by the FPUA, including but not limited to, fees and costs associated with the Project for consultants, testing, permitting, utility connections, surveying, legal, construction, construction management, certification, bonds, warranties, record drawings or any other fees and costs required to complete the Project. The timely payment by Customer of all fees and costs in accordance with the terms set forth herein shall be considered essential to the continued performance by FPUA of the terms and conditions of this Agreement. In order to ensure construction of the offsite improvements required for the System, the Customer shall provide FPUA with Security Exhibit “D” in the amount of $_________________, which represents one hundred percent (100%) of the estimated construction costs of the required offsite improvements. Attached Exhibit "C" sets forth the materials and installation costs of the offsite improvements. Customer shall provide the Security within sixty (60) days of the execution of this Agreement by FPUA. If Customer fails to commence construction of the offsite improvements as defined in Exhibit "B" and more specifically defined in the approved plans provided by _____________________________ within 180 days from the date of execution of the Agreement, FPUA may claim all monies secured by Exhibit "D", the approved offsite design provided by______________________________________, and all permits executed in conjunction with the Project in order to construct the offsite improvements without recourse from Customer or its successors or assigns. Any funds in excess of the actual construction cost shall be to the benefit of the Customer and shall be returned to Customer within sixty (60) days of the certification and acceptance by FPUA of the offsite improvements. The Customer will be liable and responsible for any cost overruns or other amounts in excess of contract price.
Offsite Improvements a. Prior to the issuance of a Certificate of Occupancy for the Project, if Xxxxxxxx has not submitted an application for a “substantial permit or land use entitlement” for the surface parking located east of the Project site along 42nd Street NW (“Offsite Parking Area”), Xxxxxxxx will replace the Off Site Parking Area with permeable space and/or buildings, with the exception of any area serving vehicular circulation for the existing and proposed buildings at 5101 and 0000 Xxxxxxxxx Xxxxxx XX, respectively. Examples of a “substantial permit or land use entitlement application” that will satisfy this condition include, but may not be limited to: (i) an application for a building permit to construct a building on the majority of the Offsite Parking
Offsite Improvements. “Offsite Improvements” means those infrastructure, utilities and other improvements to serve the 157 Acre Site as identified in Exhibit E hereto, most of which are outside the boundaries of the Remainder Cells Surface Lot including, without limitation, the construction of Lenardo Drive, Stamps Drive, and as required by the 2022 SEIR, the 2022 SEIR Mitigation Measures, the 2022 SEIR Project Design Features, and the Conditions of Approval.
Offsite Improvements. Borrower shall promptly commence and diligently complete all offsite improvements of the public streets, walks, sewers, utilities and like areas and facilities adjoining the Project, and provide utilities and other facilities, in accordance with the requirements of all Governmental Agencies.
Offsite Improvements. In connection with any Construction, Lessee may install offsite improvements it deems necessary or which may be required by Governmental Authorities, including, without limitation, curbs, gutters, sidewalks and driveway approaches. Lessee may further install or cause to be installed all necessary utility lines and facilities.
Offsite Improvements. Refer to the Street Plan for Lenardo and Stamps, titled County of Los Angeles Department of Public Works City of Xxxxxx Street Improvement Plan, prepared by Xxxxxxx Xxxxx International for detail.
Offsite Improvements. The District will be responsible for all offsite improvements necessary to the development of the Project. Sellers will work with the District in good faith to assist with any information or approvals necessary to complete the offsite improvements, at no additional cost to the Sellers.
Offsite Improvements. The Authority will construct 200 parking spaces in the cell phone lot, the retention pond, and access drives to the Travel Plaza Facility within six (6) months of the opening of the Travel Plaza Facility. The Offsite Improvements are depicted on Exhibit “A-3”. The access drives will be built to ensure that access is available in time for the opening of the Travel Plaza Facility.
Offsite Improvements. Seller has received no written notice of any public improvements in the nature of offsite improvements or otherwise which have been ordered to be made and/or which have not been heretofore assessed including, but not limited to, any road impact fee obligation, and there are no special or general assessments not of record pending or affecting the Property.
